Intergovernmental Relations Presentation to Portfolio Committee Intergovernmental Relations Presented by Mr D Powell 10 March 2003 1

Purpose To assess progress in 2002-2003. To identify outputs for 2003-2004. To identify indicative outputs for the outer years (2004/5 and 2005/6). 1

Contents Outcomes 2003-2005: stabilizing igr. Progress in 2002-2003. Policy gaps. Outputs for 2003-2004. Outputs for 2004/5-2005/6. Organizational structure of Chief Directorate. 1

Outcomes 2003-2005 I Integrating core systems of governance (planning, budgeting, implementation) for more efficient service delivery and greater developmental impact. Why is this necessary? Because spheres must work together as one government within clear and predictable “rules of engagement” to improve service delivery. 1

Outcomes 2003-2005 II Securing the place of local government within systems of planning, budgeting, implementation. Why is this necessary? Because municipalities are the institutions of government through which people-centered governance is most directly and fully expressed. And because most national policies impact locally and must be designed/refined and implemented with local conditions in mind. 1

Outputs for 2002-2003 Proposals on the distribution of powers and functions between spheres of government (July 2003). An enabling legislative framework for inter-departmental, inter-cluster and inter-sphere planning, monitoring and service delivery system (October 2003). 1

Output measures 2002-2003 Legislation regulating s139. Framework for managing assignment of powers and functions to local government. Report assessing schedules 4 and 5 of the Constitution submitted to Cabinet. Legislation implementing section 41 of the Constitution. 1

Progress 2002-2003 I Legislation regulating s139 Constitutional amendment to section 139 (provincial oversight of local government) finalised (National Treasury (lead), dplg and Justice) passed by National Assembly on 19 February 2003. Chapter 13 of Municipal Finance Management Bill before Parliament. 1

Progress 2002-2003 II Assignment of powers and functions to LG Policy framework completed (first draft). First draft tabled in G&A cluster on 20 February (Task team of G&A examining document) and 03 March 2003. Proposals consulted on in provincial conferences. Cabinet submission in April 2003. 1

Progress 2002-2003 III Assessment of schedules 4&5 Purpose is to examine practical problems with definitions and location (e.g. libraries) and to suggest refinements where needed. Bi-laterals with DACST and Home Affairs. Draft report completed, but process underway. Consultations in provincial conferences. 1

Progress 2002-2003 IV Legislation implementing s41 Section 41 Bill (first draft) completed. Policy on igr (first draft) completed. Guidelines on provincial-local IGR completed. Proposals to G&A cluster on 3 February 2003. 1

Progress 2002-2003 V Intergovernmental structures Role of PCC and MINMEC assessed and structures aligned to a government-wide focus under the Medium Term Strategic Framework (MTSF) SALGA afforded full membership of PCC. 1

Policy gaps Greater predictability and legal certainty about spheres roles in planning, budgeting and implementation (the purpose of igr) required. No framework for managing assignments of additional powers and functions to local government - assignments are ad hoc, persistent unfunded mandates. 1

Outputs 2003-2004 Section 41 Bill Introduce legislation to implement section 41 of the Constitution to stabilise igr. Extensive audit of igr completed in 2000, and good lessons for igr from ISRDP&URP. Cabinet Lekgotla resolution in January 2003. No Act to date but an Act is mandatory. 1

Outputs 2003-2004 II Broad framework legislation, creating certainty and predictability, but not rigidity. Submission of bill to cabinet in April 2003. 1

Outputs 2003-2004 III Bill will focus on: clarifying principles for inter-sphere coordination of planning, budgeting and implementation (Cabinet Lekgotla 2003); provide for intergovernmental structures; and provide for dispute settlement. Draft policy and bill completed. Submission to cabinet in April 2003. 1

Outputs 2003-2004 IV Policy framework on assignment and review of schedules 4&5: Strengthen provisions of Municipal Systems Act governing assignments of powers and functions to local sphere. Introduce policy on assignment. Assess functional definitions, and location of powers and functions between spheres. Submission to cabinet in April and July 2003. 1

Outputs 2004/5-2005/6 Administer section 41 Act. Research and refinements to igr system. Integrated information management systems. 1
