2 CIVILIAN SECRETARIAT FOR POLICE2 IMPLEMENTATION OF THE ACT SECTION NUMBER (S) SUMMARY OF SECTIONIMPLEMENTATION STEPS TAKEN/STATUSACTION Sections 4 (2), 4 (3) & 14 s. 4(2) Establishment of a Civilian Secretariat as a designated department s. 4(3) Secretary as accounting officer s. 14 Secretary’s responsibility and accountability for finances  Act put into operation, with the exception of sections 4(2), 4(3) and 14, on 1 December 2011  Prepared and published Proclamations in Gazette and amended schedules to Public Service Act. Sections 4(2), 4(3) and 14 put into operation on 1 April 2014  Amendment of Schedule 1 of the Public Service Act was gazetted on 8 July 2014  Engaged with Treasury on budget programme structure. Budget and programme structure was reviewed and aligned  Finance & IT: identified funds, assets, IT systems, etc associated with transfer of functions. Developed internal IT system and developed MOU for shared services with SAPS. Electronic accounting system was activated in September 2014  HR: Internal HR policies developed in line with DPSA policies. Supported organisational review & creation of new structure. ICT infrastructure currently awaiting roll out by SITA

3 CIVILIAN SECRETARIAT FOR POLICE3 SECTION NUMBER (S) SUMMARY OF SECTIONIMPLEMENTATION STEPS TAKEN/ STATUSACTION Section 6Functions of the Civilian Secretariat and establishment of competencies and capabilities  Established dedicated core units in Secretariat and ensured execution of functions. Policy & Research unit, Monitoring & Evaluation Unit, Partnership Unit and Legislation Unit set up  Engaged in organisational review and appointed additional personnel with required knowledge and skills. Chief Directors appointed to head respective core Units. A further work study underway due to the new status as a Department.  Developed Strategic Plans & Annual Performance Plans. Annual Performance Plan finalised and presented to Parliament  Staff signed Performance Agreements  Prepared capacity and systems for monitoring and evaluating compliance with the Domestic Violence Act and engage with IPID. OM&E provide DVA compliance reports to parliament.  Prepared capacity and systems assessed and monitoring SAPS ability to receive and deal with complaints. Dedicated Directorate established. Internal business process developed to deal with some complaints. Discussions underway with the Presidency, SAPS, IPID and Provinces for uniform business process around service delivery complaints. Business process mapping workshop postponed from October 2014 to January 2015 IMPLEMENTATION OF THE ACT

4 CIVILIAN SECRETARIAT FOR POLICE4 SECTION NUMBER (S) SUMMARY OF SECTION IMPLEMENTATION STEPS TAKEN/ STATUS ACTION Section 7 & 12s. 7 Appointment of Secretary s. 12 Minister to fill vacancy in post of Secretary  Acting Secretary appointed on 1 st September 2014  Post advertised with 31 October 2014 as closing date Appointment processes to formally appoint new Secretary will be finalised by the Minister in accordance with Public Service Act and Appointment to be finalised after consultation with Cabinet Section 10Delegations and assignment of functions Delegations not prepared yetDelegations to be finalised by end of November 2014 Section 13 & 34 (7) Secretary to submit quarterly reports to Minister and parliamentary committees  Reporting structure and template for quarterly reports to Minister and parliamentary committees developed and reports submitted Process underway to ensure more timeous submission of reports IMPLEMENTATION OF THE ACT

First Annual Report published and submitted to Parliament Working with the Auditor- General to ensure 2014/2015 Performance is appropriately audited Sections 16, 17, 18, 19 & 22 s.16. Constituting Provincial Secretariats s. 17 Alignment of provincial plans and operations and integration of strategies and systems with that of Civilian Secretariat s. 18 Appointment of Heads of Provincial Secretariats s. 19 Duties and functions of Head; Provincial Secretariat s. 22 Quarterly and Annual reporting by Heads of Provincial Secretariats on activities of provincial Secretariats  Provincial Secretariats are being constituted in all provinces, but not all are at the same level of implementation  Provincial plans are aligned with regard to Customised Indicators  Provincial Heads of Secretariat were advertised and some appointed  Provincial Budget and Programme Structures were reviewed and approved  Appointed Heads of Provincial Secretariat are performing their duties and execute their functions Filling of provincial Heads of Secretariats are being processed Vacant Provincial Heads of Secretariat posts are in process of being filled Quarterly and Annual reports will be submitted once all Provincial Heads of Secretariat are filled IMPLEMENTATION OF THE ACT

Secretary and heads of provincial Departments to meet at least on a quarterly basis s.25 (2). Senior management forum to meet bi- monthly  Heads of provincial departments forum is functioning  Senior Management Forum not established Next HOD Forum meeting scheduled for late November Senior Management Forum to be formally established once Heads of Provincial Secretariat are appointed and constitute a quorum Sections 27Ministerial Executive Committee  MinMec established and functional  Provided administrative and technical support to the Minister  Convened meeting with heads of Provincial departments to prepare for MinMec and produce documents and make briefings as may be required IMPLEMENTATION OF THE ACT

7 CIVILIAN SECRETARIAT FOR POLICE7 SECTION NUMBER (S) SUMMARY OF SECTION IMPLEMENTATION STEPS TAKEN/ STATUSACTION Sections 31 & 32 s. 31 Co-operation with Independent Police Investigative Directorate s. 32 Co-operation with South African Police Service  Co-operation addressed in Draft Regulations  Oversight workshop conducted on 24 October 2014 between SAPS, IPID, PSIRA and Secretariat  Task team established to craft an MoU between SAPS and the Secretariat  Preparations for consultative meeting between IPID and the Secretariat underway MoU with SAPS to be signed and operationalised before the end of the financial year. Section 33RegulationsDraft regulations prepared and tabled in Parliament  Promulgate regulations after Parliamentary process finalised Section 34Transitional provisions Secretary receives regular progress reports on the establishment of Provincial Secretariats at the Quarterly HoD Forum meetings Establishment of Provincial Secretariats remain a standing item on the agenda of HoD Forum meetings IMPLEMENTATION OF THE ACT
