ROMANIAN BUREAU OF LEGAL METROLOGY

REFERENCE DOCUMENTS Law 608/2001 concerning conformity assessments of the products. Government Decision 617/2003 on establishing the conditions for placing on the market and putting into service of NAWI - transposes in national regulation Directive 90/384/EEC. Government Decision 264/2006 establishing the conditions for placing on the market and putting into service of measuring instruments – transposes in national regulation Directive 2004/22/EC (MID). Government Decision 20/1992 concerning the activity of metrology. Government Decision 1055/2001 concerning the requirements for placing on the market of the measuring instruments. Government Decision 891/2004 related to applicable methods in market surveillance activities for the products included in Law 608/2001.

MAIN TASKS OF BRML-MS Market surveillance for nawi. Market surveillance for measuring instruments. Market surveillance in the field of prepackages. Metrological surveillance of measurement instruments in use. Draw up normative documents in the field of metrology. Training and examination of the BRML inspection body.

MAIN REQUIREMENTS TO ACT AS MARKET SURVEILLANCE BODY BRML-MS acts as MS body complying with ISO 17020 Independence Fairness, nondiscriminatory activity Confidentiality Management Quality System

MODALITIES OF PERFORMING MS ACTIVITIES FOR NAWI Monitoring NAWI and measuring instruments placed on the market or put into service. Taking all necessary legal measures, using the proportionality principle, to restore the conformity.

TYPES OF MS ACTIVITIES Proactive MS activities: Planned surveillance activities according with a yearly schedule. Reactive MS activities: Surveillance activities as a consequence of finding nonconformities at NAWI or measuring instruments in use. Surveillance activities as a consequence of complains received by surveillance body.

TYPES OF MS ACTIVITIES 1. Formal MS verification 2. Profound MS verification

1.FORMAL MS VERIFICATION To check: The existence and the correctness application of the conformity marking. The existence and validity of the metrological markings applied on the measuring instruments placed on the market under MID (transitional period). The existence and the correctness of the inscriptions applied on the NAWI or on the measuring instruments. The existence of the declaration of conformity issued by manufacturer/legal representative. The existence of the technical documentation. The existence of the conformity documents. The existence and the validity of the type approvals and other metrological documents issued for the measuring instruments placed on the market under MID (transitional period).

2. PROFOUND MS VERIFICATION To check: By testing the compliance of NAWI or measuring instrument with one/more essential requirements. The correctness of the declaration of conformity issued by manufacturer. The correctness and the complete application of the procedure chosen by manufacturer for conformity assessment.

MEASURES TO ELIMINATE NONCONFORMITIES FOUNDED The corrective actions depend on the seriousness of the nonconformities founded, being applicable the proportionality principle. The involved economic operator is noticed and consult about the nonconformities founded before taking any other measure, if the nonconformities not represent risks for life or health of the users. The economic operator is compelled to restore in a fixed period the conformity and to stop the infringement of legal regulations. Temporary restrictions on placing on the market. Withdraw from the market the nonconformities NAWI or measuring instruments . Withdraw from the users the nonconformities NAWI or measuring instruments. Permanent restrictions on placing on the market. Sanctions for economic operators with fine within the limits established by regulations.
