Anti-Bullying Law Commenced September 2011 Affects: Students All School Personnel Administration Board of Education

What Is Bullying? “Harassment, intimidation or bullying" means any gesture, any written, verbal or physical act, or any electronic communication, whether it be a single incident or a series of incidents …is reasonably perceived as being motivated either by any actual or perceived characteristic, such as race, color, religion, ancestry, national origin, gender, sexual orientation, gender identity and expression, or a mental, physical or sensory [handicap]disability, or by any other distinguishing characteristic

Who are the School Safety Team Members? Mr.Lowery, Principal: Primary school official responsible for identifying, incidents of HIB in the school and decides on appropriate consequences for HIB incidents based on school’s code of conduct Mrs.Osty, Anti-Bully Specialist: Conducts HIB investigation, assists the principal in appropriately applying the range of ways for responding to HIB established by the school board Mrs.McGovern, Counselor: Provides support for all students involved in an HIB incident

When and Where do We Step in? School Property At any school-sponsored function On a school bus Off school grounds when it substantially interferes with the orderly operation of the school or the rights of other students

Determination Procedures Step 1 Must meet standards 1 or 2 and standards 3 and 4: 1. Is reasonably perceived as being motivated by either any actual or perceived characteristic, such as race, color, religion, ancestry, national origin, gender, sexual orientation, gender identity and expression, or a mental, physical or sensory disability; or 2. By any other distinguishing characteristic; and that 3. Takes place on school property, at any school-sponsored function, on a school bus, or off school grounds, as provided for in N.J.S.A. 18A:37-15.3, that substantially disrupts or interferes with the orderly operation of the school or the rights of other pupils; and that 4.  Substantially disrupts or interferes with the orderly operations of the school and right of others  

Determination Procedures Step 2 Must meet at least one (1) of the following standards: 1. A reasonable person should know, under the circumstances, that the act(s) will have the effect of physically or emotionally harming a pupil or damaging the pupil’s property, or placing a pupil in reasonable fear of physical or emotional harm to his/her person or damage to his/her property; or 2. Has the effect of insulting or demeaning any pupil or group of pupils; or 3. Creates a hostile educational environment for the pupil by interfering with a pupil’s education or by severely or pervasively causing physical or emotional harm to the pupil. “Electronic communication” means a communication transmitted by means of an electronic device, including, but not limited to: a telephone, cellular phone, computer, or pager.

The superintendent must report at two public hearings – District Reporting School Report Card Data –requires schools to report the number and nature of all reports of HIB The superintendent must report at two public hearings – One between 9/1 and 1/1; and One between 1/1 and 6/30
