1 Presented to the City Council by the Planning and Development Department March 31, 2009 HISTORIC PRESERVATION ORDINANCE UPDATES

2 Purpose Inform City Council on proposed amendments to the historic preservation ordinance. Receive comments before proceeding with updates.

3 Why does the preservation ordinance need to be updated? ClarityReduce subjectivity and remove obsolete information from ordinance language ConsistencyIncrease uniformity of case review while reducing repetitive procedures EfficiencyReduce unnecessary case load for Historic and Cultural Landmarks Commission (HCLC) members and staff

4 What ordinance amendments does staff recommend to address clarity? Contributing (Fairmount)Non-contributing (Fairmount) Establish detailed criteria for historically contributing and non-contributing structures.

5 Add language that better defines economic hardship. Remove requirement that HCLC appoint two members to Scenic Preservation and Design Review Commission (SPDRC), which is now Urban Design Commission. What ordinance amendments does staff recommend to address clarity? (cont.)

6 Require new HCLC hearing if new evidence is presented to Appeals Board. Allow any interested party to appeal HCLC decision. What ordinance amendments does staff recommend to address consistency?

7 Allow Council-initiated changes to district standards and guidelines without also requiring a petition. Amend zoning ordinance to provide that a variance is not required from the BOA where a setback is consistent with the historic district. Extend life of certificate of appropriateness from six months to two years. What ordinance amendments does staff recommend to address efficiency?

8 Allow administrative approval of all changes to non-contributing structures except new construction or additions seen from public right-of-way. Allow administrative approval for changes to contributing structures where both an active neighborhood committee and City staff agree, except new construction or additions as above.
