Nordlaw Cottage Inc. Site Plan Control Agreement Process: Tonight is the first opportunity for public review and a chance for Committee of the Whole to ask questions. Committee will make a recommendation to Council to: Approve a draft site Plan Control Agreement with conditions, or Defer back to staff for more information, or Deny the application. Council will vote on the proposed resolution next week. If approved with conditions, the proposed final Site Plan Control Agreement would come back to Committee of the Whole for discussion before Council approves the final agreement.

Nordlaw Cottage Inc. Site Plan Control Agreement This application is the first stage in redeveloping the former Nordlaw Lodge property at 489 Crozier Rd on Bob’s Lake. The condominium exemption process is proposed to create freehold ownership of 18 seasonal cottages with shared ownership of laneways, water front access, etc. Six existing cottages close to the shore of the lake are proposed to be removed as are the two wings of the existing Lodge. Some new units are proposed but for the most part the development is being carried out on the locations of the existing cottages and cabins. Approximately 513 m2 (5,522 sq ft) of existing development is proposed to be removed overall.

Nordlaw Cottage Inc. Site Plan Control Agreement Purpose A Site Plan Control Agreement is placed on title in order to protect the water quality of a lake or stream and the groundwater. The Site Plan Control Agreement for Nordlaw Cottage Inc. will include these elements of their plan: Location of the proposed buildings and parking, Lot grading and drainage measures to reduce stormwater run off to the lake from the proposed construction, Vegetation to be retained or added, Points of access to the lake for pedestrians and for boats, Location and design of septic systems, Location and design of drinking water sources, etc.

Nordlaw Cottage Inc. Proposal In detail the proposal involves: Removal of the 5-unit cabin within 10 metres of the water Removal of one waterfront cabin Replacement of the 5 separate cabins based on a granted Minor Variance for three cabins (28m, 22m, 15 m from the water) Retention with renovation of the Waldron Building . Removal of one residence (to the rear of the pool) and replacement with 5 new cabins on or around the same location Renovation or replacement of 3 existing cabins on the same footprint Partial removal and renovation of the main lodge Replacement of cottage and retention of garage, south-east corner Construction of 2 new cabins at 46 and 43 metres from the water (east end) Retention of the boathouse on the bed of the lake Retention of the existing crib and floating docks (no change proposed at this time)

Nordlaw Cottage Inc. Comments Planner: The Official Plan designates the property as Rural. Tourist Commercial policies include various types of tourist lodging facilities and recreational areas. The proposal is for some of the units to be rented out by the management company and some to be owned by individuals who would use the management company to arrange rentals on their behalf.

Nordlaw Cottage Inc. Comments Planner: The land is zoned Tourist Commercial. Lot coverage for the 2.4 ha property (approximately 1,956 m2) is 8.2 % which is under the 20% permitted and is reduced from 9.6% lot coverage for the existing development. Setbacks that meet or exceed 30 m from water are proposed for new construction (with a minor variance approved for 3 cottages proposed for expansion currently located at 15, 21, 28 m from the lake and as of right reconstruction of two existing non-complying cottages on the existing footprint).

Nordlaw Cottage Inc. Comments Planner: The tourist accommodations provided by the Lodge cottages previously slept 78 people. With 18 units proposed and an assumption of 2.5 people per unit the proposed development would sleep 45 people. There was restaurant capacity for up to 240 persons previously. The proposed development will not have a restaurant, bar or patio so that intensity of use will no longer be on the site. A snack bar and gas pumps associated with the dock is proposed to remain and tourist visits are expected to continue.

Comments Rideau Valley Conservation Authority: has no objection to the proposal recognizes that the overall redevelopment plan will be a considerable improvement to lake impact factors sees great potential for low impact and “green” redevelopment has provided the flood elevation to the applicants requested grading changes, additional protective measures (such as enhanced vegetation), and access to the water to be shown on the Lot Grading and Drainage Plan requires mitigation measures east of the Lodge to avoid a concentrated flow of site runoff that could increase potential sediment and nutrient loading to the lake would not support new shoreline access from individual cabins supports the continued use of pea stone or other porous surfaces as opposed to hardened surfaces for parking and access ways recommends that parking areas and driveways be limited to the area east of the Waldron Building

Nordlaw Cottage Inc. Comments Ministry of the Environment and Climate Change Sites with a daily septic design flow over 10,000 litres per day require approval under the Ontario Water Resources Act by the Ministry of the Environment and Climate Change (MOECC). The applicant is developing a detailed design, with MOECC consultation already underway. All required approvals, for replacing the existing sewage systems with new Class IV OBC-compliant systems, will be obtained prior to final Site Plan approval. MOECC is also responsible for licensing communal water supply. Finally, MOECC is responsible for regulations related to fuel pumps and service on the dock.

Nordlaw Cottage Inc. Comments Ministry of Natural Resources and Forestry: The applicant is waiting to hear from MNRF on any public land issues related to the bed of Bob’s Lake. MNRF clarification is needed for RVCA to determine where to apply Regulation 174/06. Public: An letter from Ms. Laatunen was supportive and raised questions regarding boating traffic, proposed population density and the types of studies required for the proposal. Positive comments were received from Mr. and Mrs. Powers, Mr. Webster, Ms. Bracken and Ms. Walker. No negative comments were received.

SPCA Conditions to be developed The final Site Plan Control Agreement can be approved by Council when: comments from MOECC and MNRF are received RVCA approves additional management plans for storm water related to runoff from the new proposed parking and the laneway the issue of securities for the communal septic system and communal water system is addressed Draft approval from Council for the concept plan is being recommended by staff at this time.
