For example, will Deviation (2) be legally accepted by countries applying Deviation (1)?

A to E are the latest versions for which the TP period expired. - Under the principle of mutual recognition under the 58 Agreement, all IWVTA (partial and universal) are recognized by all CP applying R0. - For registration purposes, each CP may request, in addition to the partial IWVTA, further technical requirements. - A CP applying R0 may grant IWVTA according to each of its Series. - Each CP applying a series of R0 shall notify to UN Secretariat its level of application, if different from the latest series of R0 (Universal IWVTA). - Each CP applying a series of R0 shall recognize the (universal) IWVTA. - Upgrades of a specific series of R0 can be made by Supplements to that series (t.b.discussed). - For national registration purposes of vehicles covered by an IWVTA of limited recognition, each CP may request additional requirements not covered by the partial IWVTA (upgraded or additional Regulations, t.b.d.). 5 Proposal by OICAProposal by UNECE TD Legal perspectiveNeed to stipulate the special treatment in the 58 Agreement (or possibly R0) about the acceptance of IWVTA of limited recognition. (*1) Addressed by the current 58 Agreement Flexibility with regards to the application of each Regulation in R0 LargeLimited (*2) Complexity of the judgment of acceptance of the given IWVTA Evaluation tool is needed.Series number will help CPs to judge the acceptance of given IWVTA provided that there are no deviations made by each CP within the same series of R0. Otherwise, still some kind of evaluation tool is needed. Workload of administration Large (have to manage the amendment of the latest series of R0 and all the deviations of each CP whenever they are introduced) Small (have to manage only the amendment of the latest series of R0 and supplements of each series of R0 in order to upgrading it) Comparison of two proposals for flexible IWVTA scheme

Note: (*1) The current UN R0 proposed by OICA include both Section 1:“List of mandatory requirements” (Universal IWVTA) and Section 3 “List of alternative requirements for a IWVTA with limited recognition” of Annex 4 in one series of UN R0 (e.g. UN R0-01 Series). Therefore, legally speaking, it is difficult to differentiate the universal IWVTA from that of limited recognition under the current 1958 Agreement in terms of acceptance of those IWVTAs because both IWVTAs belong to UN R0-01 Series. Thus, some special treatment may need to be stipulated in order to allow the CP to refuse the IWVTA of limited recognition. ( *2) The series of each individual Regulation in R0-00, for example shall be equal to or earlier than the series of that Regulation in R This puts some limitation in flexibility regarding the application of Regulations.
