The official letter has been sent to Stuart Kerry, Chair of the IEEE Working Group, and to the IEEE Patent Office. Earle Thompson of the Texas Instruments Legal Department submitted the letter. January, 2001 doc.: IEEE /023r1 Slide 5Submission Chris Heegard, Texas Instruments General Terms Texas Instruments Incorporated (“TI”) is pleased to announce that TI shall, upon request, grant non-exclusive licenses on reasonable and non- discriminatory terms (which may include TI’s then current royalty rates) for only such portion of any product which is fully compliant with the IEEE g standard, to any such requester under any existing and pending patents of TI which would necessarily be directly infringed by the manufacture, sale and implementation of such product solely because it is fully compliant with the IEEE g standard, and provided that a similar grant under such requester’s patents within the scope of the license granted to such requester is made available to TI.

Heegard, M. Shoemake, E. Rossin, S. Coffey and A. Batra (document number IEEE /384) be adopted in its entirety (including protocols, physical layer specifications, fallback modes, etc., excepting TI approved minor modifications) as the sole mandatory implementation for the IEEE g standard, TI shall, upon request, grant non-exclusive royalty-free licenses only for such portion of any product which is fully compliant with the IEEE g standard, to any such requester under any existing and pending patents of TI which would necessarily be directly infringed by the manufacture, sale and implementation of such product solely because it is fully compliant with such IEEE g standard, and provided that a similar royalty-free grant under such requester’s patents within the scope of the license granted to such requester is made available to TI.
