4 4 Changes or items being considered in PSO IPR Policies Potential items to be discussed: –Essential Copyrights –Trademarks –Unpublished pending patent applications vs. published patent applications –Disclosure –Consideration of policies of External Organizations Scope of licensing obligation Normative Referencing –Governmental Requests Contributions from ETSI, TTC, and oral inputs from many, more details in the following slides.

5 5 Changes or items being considered in PSO IPR Policies Main outcome: –TTC IPR committee addressing Software copyright; Consistency between TTC IPR rules and ITU/ISO/IEC common IPR rules; and Enhancement of TTC IPR rules (Cont. 3) –ETSI completed it review and updated its Policy and Guidelines (Cont. 4r1, 5) –TIA has made a major change in how it handles LoAs for normatively referenced documents

6 6 ITU, ISO, and IEC Patent, Software Copyright, and Marks update Issues discussed: –Participants received an update on TSB Director’s IPR Ad Hoc group results (Cont. 02, 02a1) Main outcome: –ISO/IEC/ITU-T/ITU-R have a COMMON Patent Policy, Patent Guidelines, and Patent declaration form –ITU-T has Guidelines on Software Copyright and Guidelines on Marks –ITU-T is developing an improved on-line database of patent declarations

7 7 IPR Policies and Current Issues of Organizations External to GSC PSOs Updates from External Organizations: –OMA provided an oral update –A European Patent Office (EPO) contribution (Cont. 6R1) –IEEE- SA Contribution (Cont. 10, 10a1) –BWCI Contribution (Cont. 13) Main outcome: –OMA decision to harmonize its policy with those of PSOs and ITU with regard to the scope of the licensing commitment is welcomed –EPO has amassed a large data base of information to use in identification of prior art, and EPO is getting drafts and technical inputs from SDOs, a forecast of some possible futures was presented –IEEE has updated its policy –BWCI is in the process of adopting an IPR Policy –SDOs should cooperate with their PTOs

8 8 ANSI update on IPR issues in USA Issues discussed: –New ANSI IPR Policy Committee –FTC/DOJ Hearings, report issued (Cont. 9, 9a1) –Rambus Decision (Cont. 14) Main outcome: –No specific ANSI Contribution to this meeting –Contributions on FTC/DOJ hearing and Rambus Decision by the Chair for updates on some recent events in USA

9 9 Experience of practical implementation issues under existing policies Potential Issues that could be discussed: –Source Code Copyrights used in Standards –Evaluation licenses on Source Code submittals –Trademarks in Standards, both SDO-owned and commercial –IPR Declarations, IPR Databases –Technical means to protect copyrights of SDOs including Digital Rights Management (DRM) implementations Main outcome: –Practical issues were covered in earlier Contributions of PSOs related to evolving policy issues

10 Considerations for Developing or Revising SDO IPR Policies Issues discussed: –ABA Committee overview (Cont. 8) –TIA Contribution on “SDO IPR Policies, RAND/FRAND or Compensation-Free, the impacts on Participation, Standardization, and Innovation in the Market” (Cont. 11) Main Outcome –ABA book which will useful in drafting, revising, and understanding SDO IPR Policies to be published in August 2007 –RAND/FRAND IPR policies work for standardizers and should be periodically reviewed, but there should be an understanding of the various business models that drive IPR licensing

11 11 Summary Fruitful discussions on a range of topics IPR WG to meet during GSC-13. Time Allocation: At least half a day, same as GSC-12 and same meeting time template Resolutions drafting group formed, TIA Lead, look at IPR Resolution and Cooperation with PTOs Input to HoDs and GSC-13 host for planning of next meeting and allocation of time for IPR discussions
