1 IAOPA Regional Meeting Larnaca 22 September 2007 EASA OPS.001 Working Group

2 Objectives:  Convert existing JARS into EU implementing rules and create new EU regulation for: All General Aviation (OPS 0 – MDM032) Commercial Aviation (OPS 1) Non-commercial complex aircraft (OPS 2) Aerial work (OPS 4)

3 Working Group Status  All subgroups ended their work in June  Core group should have met for 4 days in July 07 to review subgroup material That meeting was cancelled by EASA  EASA to do final drafting  Core group was to rejoin in October 07 to review material before NPA postponed till November by EASA

4  EASAs complaint: Working groups are asking for too heavy regulation  EASAs redrafting of working group material to be presented to the OPS.001 core group in November  NPA expected to go out 1Q 2008 ...provided that EU Parliament and Council agrees!

5 Role of the EU Parliament  Must adopt the 1592/2002 proposal that gives EASA the authority over OPS and Licensing  Currently this regulation is disputed between Parliament and Council Definition of Complex Aircraft Assessment Bodies

6 Complex aircraft – Disputed items: MTOW over 5.700 kg or; max approved seating capacity of more than 19 or; 2 pilot aeroplane or; equipped with turbojet engine(s)

7 Requirements for any complex aircraft (1592/2002 proposal)  Submit a declaration of activities and means  Implement & maintain a management system  Establish and maintain an accident prevention and safety programme, including an occurrence reporting programme  Operations Manual  Procedures for disruptive passengers  Security programme: Security of flight crew compartment, aircraft search procedure checklist, security training programmes etc.  Fatigue Management System

8 Complex aircraft – a moving target  EU Council wants to: Add all turboprops to definition  EU Parliament wants to: Exclude simple VLJs from definition by Removing ”jet engines” from definition Increasing max seats from 9 to 19 seats

9 IAOPA achievements in Parliament:  EU Parliament proposal 100% based on IAOPA proposal accepted at the previous regional meeting  IAOPA participated at internal Parliament strategic meeting in June and motivated our position.  The Parliament is prepared to defend this position through second and maybe third reading  IAOPA has drafted the Parliament position paper to the Commission

10 Main arguments of IAOPA/Parliament position paper:  Encouraging operators to trade a multi-engine turboprop for a single engine equivalent does not increase safety. It is just doing away with the added safety of an extra engine  Comparison of single engine turboprops with low end turbojet aircraft

12 Where to place the Ops Manual?

13 Possible compromise  Turbojet criteria to be supplemented by a speed and altitude criteria For instance 350 knots / 30.000 ft  Odds of having the new ICAO definition modified accordingly?

14 Other outcome of Parliament meeting:  Mandatory background checks of all Pilots hopefully prevented Adopted by Parliament in second reading of 2005/0191 security regulation Apparently not the intention of the Parliament but Parliament cannot change this decision After pressure from IAOPA the Parliament is now working behind the scene to make the Commission reject the Parliament's own proposal The Commissions rejection came in August 07
