2 The context of EU/NATO arrangements in the sphere of security and defence The Transatlantic relation/ MSs members of both NATO and the EU The EU definition of its security and defence role - Cologne Conclusions (June 1999)- collective defense will remain a responsibility of NATO - The Treaty of Nice (Feb. 2003)- an EU operation will be launched when NATO as a whole in not engaged EU deficiency in institutional and strategic capabilities -Institutional capabilities: operational HQs, the need of recourse to SHAPE and CJTFs -Strategic capabilities: intelligence, command, control and strategic lift

3 Modalities for consultation and cooperation between the EU and NATO on defense- principles Feira Presidency Report (June 2000)- recommends the setting up of four ad hoc EU/NATO working groups on security issues: on preparation of security agreements; on headline and capabilities goals; on modalities enabling EU access to NATO assets and capabilities; and on definition of permanent arrangement for EU- NATO consultation in times of crisis or non-crisis Principles to inform the development of modalities for EU-NATO cooperation and consultation: -Autonomy of EU decision-making -Equality of the two organisations and non-discrimination against any MS -Organisations’ shared values and spirit of partnership -Recognition of the different nature of the two organisations

4 Modalities of ESDP/NATO military planning arrangements Objectives: -Information exchange on military planning -Defence planning of the Union and Alliance compatible and coherent Rational: each NATO and EU MS has the same set of forces and defence budget Agreements: - Access of designated EU and MSs officials to NATO’s planning facilities - Access to three layers of planning and command capabilities: strategic operational HQs, theatre and components HQs

5 Modalities for consultation in defining EU capabilities goals Objective: a method for consultation in defining ESDP capabilities goals; consultation on determining review mechanism on the progress towards the capabilities goals coherent development of capabilities of the Alliance (arising from NATO’s DCI) and the Union ECAP (Nov. 2001) and DCI share objectives and method- discussions of panels of experts Rational: the precedent of the HTF Plus; MSs of both NATO and the EU; deficiencies in EU capabilities Arrangements -exchange of information -same review mechanisms

6 Modalities for EU access to NATO capabilities and resources Berlin (1996) arrangements for WEU access to NATO capabilities NATO’s Washington Summit Nice Presidency Report, Annex VI- ties the planning procedure for EU-led operations with recourse to NATO’s assets and capabilities to Alliance’s operational planning Prague NATO Summit (Nov. 2002) and the Copenhagen European Council (Dec. 2002) endorse the Berlin Plus arrangements

7 Modalities for consultation and cooperation in situations of crisis and non-crisis Nice Presidency Report, Annex VII, Standing Arrangements for Cooperation and Consultation between the EU and NATO Routine phase: COPS and NAC- three times during the term of a EU Presidency and at least one ministerial meeting between the EU and NATO; NATO and EU Military Committees- meet at least once for the term of a EU Presidency; EU/NATO ad hoc groups Operational phase: EU Ministerial meetings invite NATO Secretary General; Chairman of NATO’s Military Committee at EUMC meetings and DSACEUR
