4 §126-14-3. Definitions. 3.1 Accommodation(s). At the IEP meeting, student Roy’s parent demanded that he be given the accommodation of R04 because he does not like to write and is not a good writer. However,… Roy performs writing assignments w/o the aid of a scribe in the daily classroom setting. What problems do you see with this situation?

5 §126-14-3. Definitions. 3.1 Accommodation(s). Since Roy’s IEP has the scribe accommodation indicated and he used a scribe for the Online Writing section of WESTEST 2, would a scribe verification form be needed for WESTEST 2? Discuss.

6 §126-14-3. Definitions. 3.10 Cheating. Roy has taken the Online Writing section of WESTEST 2 with the scribe, as per IEP As a scribe, Alice keys in Roy’s oral response to the writing prompt he is assigned. Roy reads what she has keyed in before she submits the essay. Discuss if the proper scribing protocol for “direct telling” was followed.

7 §126-14-3. Definitions. 3.19. Home-Instructed Students Roy was a home-instructed (home- schooled) student at the time he completed the Online Writing session of WESTEST 2. Since then, he has enrolled in public school and will take the May sessions of WESTEST 2. What should be done to ensure that his performance on Online Writing is combined with his performance on the multiple choice sections of WESTEST 2 RLA?

8 §126-14-3. Definitions. 3.20. Homebound Students Roy is currently on homebound instruction. He needs to take all sessions of WESTEST 2, including Online Writing. What should be done to ensure that Roy has every opportunity to complete all sessions of WESTEST 2?

9 §126-14-4. Program Regulations. 4.4. WESTEST 2 or APTA In grades 3 – 6, Kyla was assessed on WESTEST 2, as per IEP placement. The IEP for her seventh grade school year (2008-2009) reflected WESTEST 2 assessment, but in March 2009, it was determined that she should be assessed by APTA. Discuss what you might see as problematic with this decision.

10 §126-14-5. Administration Regulations. 5.3.4. What constitutes a breach? While Mrs. Brown’s 5th grade class was testing, the fire alarm sounded. She had students place answer sheets inside and close test books. She had students exit the room, locked the door and followed. After the drill she resumed testing, even though one girl was upset because her home had recently been destroyed by fire. She did not fill out a Testing Irregularity Form. Discuss the appropriateness or inappropriateness of Mrs. Brown’s actions.

Wrong to Right Erasures As Mrs. Brown walked around the class while students completed Math WESTEST 2, she noticed several students were marking the same incorrect answer on many of the items. She drew their attention to the fact they could erase and may want to consider doing so on “x” number of items. They did, constituting many erasures. What might happen as a result of this?

Family Education Rights and Privacy Act (FERPA) Parent A wants to review her child’s Individual Right Response Report and calls the school counselor to request this report, stating that she needs it mailed since she cannot get to school to pick it up. Counselor says, “Oh, I have it electronically; I’ll just e-mail it to you.” Is this a wise decision?

Family Education Rights and Privacy Act (FERPA) Teacher A wants to review her student’s Individual Right Response Report to plan the best instruction for her 6 th grade class; she downloads the IRR Reports onto a USB so she can have it at home as she works on her plans. Her son, who is in another 6 th grade class at the same school, realizes what is on the USB. He e- mails the information to his three best buddies, who are also in 6 th grade at the school.

18 Investigative Process Investigations start when an allegation is reported Allegations can be made by any of these individuals: School Administrator Teacher County/School Employee Parent Anonymous

19 Reporting Allegations Allegations must be reported immediately to the Office of Assessment, Accountability and Research (OAAR) –Investigative Team comprised of personnel from OAAR/Office of Legal Services and/or County meets to determine severity of the allegation

20 Team Determines that Allegation Falls into One of the Following Categories Testing irregularity caused by –Disturbance –Sick student –Failure to implement accommodations as per student’s IEP –Warrants No investigation Security breach/testing administration breach/cheating –Unauthorized person handling/access to testing materials –Missing test booklet –Cheating –Copyright violation –Investigation Warranted

Legal office reviews/determines if behavior rises to the level of licensure revocation/suspension License can be revoked/suspended by State Superintendent
