2 2 Is it illegal or unsuitable? To send an email to your unsecure hotmail, yahoo or web-based email account, because you need to finish some work from home, which is then attacked by phishing malware?

3 3 Is it illegal or unsuitable? unsuitable - but may be illegal depending on the circumstances. Under the Fraud Act 2006 possessing or having under your control any article for use in the course of, or connection with any fraud, for example, possession of computer files in preparation for launching a 'phishing' attack carries a maximum sentence of 5 years imprisonment.

You could be charged under the Public Order Act 1986 if you use threatening, abusive or insulting words or behaviour, within the hearing or sight of a person likely to cause harassment, alarm or distress.

It could compromise the person’s professional standing, or make them open to an allegation could be made against them.

It could compromise the person’s professional standing. Many recruitment agencies and employers now undertake an internet trawl of prospective employees, and if unsuitable behaviour or comments are found on their social networking profile they will be unlikely to be hired.

Under the Safeguarding Vulnerable Groups Act 2006, it could also be looked as financial or material abuse, which includes theft, fraud, exploitation, or pressure in connection with the misuse or misappropriation of, property, possessions or benefits where it relates to a vulnerable adult.
