4 Alabama National Guard Prevention, treatment, and outreach Program objectives  Terminal Learning Objective: Given a scenario where a service member is abusing drugs or alcohol, determine if the member qualifies for Limited Use protection and identify ways for the member to self-refer for the problem.  Enabling Learning Objectives: Define and understand the Limited Use Policy Discuss Self-referral and how to get help Determine the benefits of getting help versus getting caught

5 Alabama National Guard Prevention, treatment, and outreach Program LIMITED USE POLICY  Purpose: Encourage those who need help with a substance abuse problem, or those abusing drugs or alcohol, to self-refer so they can get help.  Protected Evidence: Limited Use Policy prohibits the use of evidence against a soldier in courts-martial proceedings, UCMJ action, and determination of characterization of service.  Separation: No separation action is required by the Commander. If administratively discharged, the member will receive an Honorable Characterization of Service.

6 Alabama National Guard Prevention, treatment, and outreach Program Limited Use Policy (continued)  Qualifications:  Self-refer to commander, NCO or officer in chain of command, chaplain, or JSAP office  Must not have knowledge of a pending drug or alcohol test  Provide commander with facts and circumstances of the use  Be evaluated by a state-certified treatment counselor  Follow all recommendations of the treatment counselor  Sign consent to release treatment information

7 Alabama National Guard Prevention, treatment, and outreach Program Limited Use Policy (continued)  Limited Use does NOT apply to:  A positive test that results from law enforcement activities  Information concerning drug or alcohol abuse or possession of drugs for personal use occurring after a member’s self-referral

8 Alabama National Guard Prevention, treatment, and outreach Program Limited Use Policy (continued)  Example 1: Does Limited Use Policy Apply? SPC Joseph Snuffy has been having a difficult time dealing with problems in his personal life. He lost his job and his girlfriend broke up with him. He started smoking marijuana because it helped him forget the problems he was having. After a couple weeks he realized that marijuana was affecting his concentration and was causing him much anxiety. He decided he needed help for this problem. On Saturday of drill he talked to his squad leader and expressed wanting help for his marijuana use. His squad leader reported this to his commander who counseled SPC Snuffy and referred him to community based treatment. SPC Snuffy told his commander the situation and why he used the drug. The next day his commander directed a random drug test and SPC Snuffy was picked to provide a sample. The sample returned positive for marijuana. Limited Use Policy DOES Apply in this Situation

9 Alabama National Guard Prevention, treatment, and outreach Program Limited Use Policy (continued)  Example 2: A1C Linda Smith started smoking marijuana and using cocaine after she returned home from basic training. During Saturday of a drill weekend she was selected for a random drug test. After the commander ordered the selected members to test she provided a sample to the Unit Prevention Leader. Later that day, she asked to talk to the commander. She told the commander she had been using marijuana. The commander counseled her and provided her with resources to community-based treatment. The sample returned positive for marijuana and cocaine. Limited Use Policy DOES NOT Apply in this Situation

10 Alabama National Guard Prevention, treatment, and outreach Program Self-referral  Why Self-refer? – If you get caught by law enforcement or through a drug/alcohol test… You could loose benefits (education incentives, etc.) You could have to repay a bonus You could get discharged unfavorably You could lose credibility with your unit, peers, family, etc.

A member who has a substance abuse problem, can see help from: Commander Officer or NCO in chain of command Military Chaplain (must waive right to privilege communication) JSAP/PTO Office – 334.274.6304 Or ngalpto@ng.army.mil Self-referral (CONTINUED)
