4 Why QBS? Why QBS? Seek the best value for the health and welfare of the public Design costs are a low percentage of the construction and maintenance costs of the project (a few dollars saved in design could end up in increased construction and maintenance costs) Develop a partnership between agency and the design professional

5 The Idaho Law Idaho Code 67-2320 – Professional Service Contracts with Design Professionals, Construction Managers and Professional Land Surveyors For projects with design fees over $25,000 – oEstablish and make available selection criteria and procedures oDevelop RFP/RFQ and publish notice oSelect “best qualified” firms and rank in order of qualifications oBegin negotiation on scope of work and fees with top ranked firm oIf the agency cannot reach a mutual agreement, move to the next firm on the list oWhen an agreement is reached, develop a contract Agencies may ask for firm rates, overhead multipliers but cannot ask for the fee or other costs. None of this information may be used in the selection process.

6 The Idaho Law Idaho Code 67-2320 – Professional Service Contracts with Design Professionals, Construction Managers and Professional Land Surveyors For projects with design fees under $25,000 – oThe agency may use the guidelines set forth for projects over $25,000 or may “establish its own guidelines for selection based upon demonstrated competence and qualifications to perform the type of services required.” Other Points: o Associated or Phased Projects o Hiring Roster oSimilar Federal Law – the Brooks Act

8 Ranking the Firms Some criteria you can consider: Expertise Project Understanding Schedule – Can they perform? Prior Experience (firm and/or individual staff) References Licensing and Registration as appropriate Process – Written proposals Interview Process We can provide expertise on how to rank
