5 Upon integration of the arts into major subjects in fourteen New York elementary an secondary public schools, student behavior improved strikingly in such areas as taking risks, cooperating, solving problems, and being prepared. Created from PL (1990) Reauthorized and transformed in 1997 Congress took testimony from hundreds of professionals, teachers, parents, advocates, etc. children in spec. ed were not reaching their potential due to the separate system. *Main point: IDEA is intended to insure a child’s access to the general education curriculum. * Presumption: children with disabilities are MOST appropriately educated with their non-disabled peers. *Separation from non-disabled peers can ONLY occur when the child’s disability is so severe that even with supplementary aids and services, the child’s education in regular classes cannot be achieved satisfactorily. * Burden of proof is on the school/district. General Curriculum Emphasis: Regular educator MUST be part of the IEP team. General educator carries out specially designed instruction when the special educator is not present, is on team to develop a behavior plan, etc. Team is expected to adapt/modify/provide aids, a BSP etc. BEFORE a more restrictive program, like Life Skills, is considered Parental Rights / Due Process - time lines, stop changes in placement Procedural Safeguards: PA is more stringent than feds. 10 days, 15 cumulative, MR is any suspension, MR IQ is below 80 (more identified as MR), steps that must occur before removal (IEP meeting, Funct. Assess, BSP, Manifest determination).

8 Why Engage Emotions? Medial brain (the limbic system) is closely linked to memory encoding and retrieval More pathways reach from the limbic system to the cerebral cortex than vice-versa The reticular activating system (filter) can be by-passed by emotions

Music and drama allow for cooperative groupings Drama activities speak to students’ natural inclination to talk and socialize Drama activities don’t control – they channel!

10 They allow for movement that is educational
Music, movement, and drama can help to channel students with high activity levels They allow for movement that is educational Fun = engaging = fewer behavior problems! Mental health services that provide long term therapy, counseling, behavior management programs, TSS services, etc are not an entitlement. They can be stopped if it is deemed not necessary, if the insurance runs out and/or if the child doesn’t want services (after age 14).
