3 1.6.2015 Background The informal IMPEL Network is for authorities dealing with supervision and permitting in all EU countries and accession countries One key priority in EU 6. Environment Action Programme is to cut greenhouse gas emissions General principle of efficient use of energy in Article 3 of the IPPC Directive 96/61/EC Application requirements in Article 6 of the IPPC Directive Energy efficiency requirement and BAT in Article 9 In Article 9(8) is stated that general binding rules can be used Environmental Management Systems (ISO 14001 and EMAS) and energy saving agreements are voluntary methods to achieve energy efficiency

5 1.6.2015 Objectives of the project Investigate options for regulating energy efficiency in environmental permits Harmonize the implementation of the IPPC Directive (Articles 3, 6 and 9) Study the role of the authorities in assessment of energy efficiency in applications and permitting Study energy efficiency in BAT Reference Documents (BREFs), voluntary environmental management systems (EMSs) and voluntary energy saving agreements Study cooperation between environmental and energy administrations Find out good practices in the European Union Member States

6 1.6.2015 Participation in the project Austria, Denmark, France, Germany, Ireland, Italy, Lithuania, the Netherlands, Poland, Portugal, Sweden, the United Kingdom and Finland (11 Member States + 2 Future MSs) The IMPEL coordinator The EU Commission In the Advisory Committee were following countries represented: Austria, Finland, Germany, the Netherlands, Sweden and the IMPEL coordinator

Energy efficiency in the permit procedure 5. Energy efficiency in BAT 6. Voluntary energy saving agreements

Key difficulties The authorities role is not easy: Definition of energy efficiency in permitting Definition of binding, enforceable permit conditions Enforcement and supervision Publicity vs. confidentiality Relations to emissions trading Voluntary systems vs. permit Lack of information and expertise

10 1.6.2015 2.a Good practice Definition of energy efficiency in practical guidelines, benchmarking, pinch technology or energy balance checking Beforehand discussions between operator and authorities and application forms available on the Internet Energy efficiency as a binding permit condition could not be identified but some good examples are written down in the report In the BREFs are specific information on energy consumption and some data on energy saving and energy recovery and that data should be used both by authorities and operators

11 1.6.2015 2.b Good practice In monitoring and supervision self control can be used if the inspector can influence the practices Use of energy audits and the audit report Cooperation between energy and environmental authorities Transparency in the permitting procedure and the voluntary measures When voluntary energy saving agreements are made for most of the industry Training in energy issues for environmental authorities, fact sheets and information from energy audits

Energy efficiency in permitting in practice Requirement for energy efficiency as important as the permit conditions on emissions Not yet many examples of permit conditions No guidance yet Links between permits and voluntary saving agreements useful Voluntary energy saving agreements can lead to energy savings Information from voluntary energy audits can be useful The environmental authorities do not have enough knowledge in energy issues and training is required

16 1.6.2015 Conclusions Defining energy efficiency is difficult Consideration of energy efficiency as important as technical permit conditions Guidance as general binding rules, sector-wise guidance or application forms important Voluntary systems should be used more BREFs should be used and developed further The link between permitting and voluntary systems should be clarified The relations between emissions trading and energy efficiency in permitting should be improved
