With or to join the worker, or on own as worker From one school district to another Change of residence For economic necessity Within the past 36 months ANDAND ANDAND ANDAND ANDAND What is a “qualifying” move? A qualifying move: 1. is across school district boundaries; and 2. is a change from one residence to another residence; and 3. is made due to economic necessity; and 4. is made in order to obtain qualifying work; and 5. occurred in the preceding 36 months. Note, all criteria must occur in order for a qualifying “move” to take place. the child(ren) must move on own or "accompany" the worker who moved in order to obtain or seek qualifying work or the child (ren)who moves separately to “to join” a parent, spouse, or guardian. the child(ren) has moved from one school district to another “residence” to be a place where one lives and not just visits. In certain circumstances, boats, vehicles, tents, trailers, etc., may serve as a residence. economic necessity means that the worker moved either because he or she could not afford to stay in the current location, or went to a new location in order to earn a living. The child(ren) moved within the preceding 36 months in order to seek or obtain qualifying work, or to accompany or join the migratory agricultural worker or migratory fisher. The child and worker “moved” M I G R A N T S T U D E N T D A T A & R E C R U I T M E N T O F F I C E

X Things to remember on a “to join” Things to remember on a “to join” Remember that on a “to join” move there needs to be two comments. State the purpose of the first “move.” State the purpose of the “to join” move. Mr. Valdez moved on 06/16/2010 to secure employment picking cherries. The children arrived on 08/20/2010 to join father, and attend school.

X Keep in mind when completing 4Cii “other credible evidence” Keep in mind when completing 4Cii “other credible evidence” OME states that family members of the worker cannot be the additional information that supports the worker’s or family member’s statement that the worker sought the qualifying work. H & H Farms orchard manager states that they have acquired the needed crew for the harvest and are not hiring at present time.

X Take special note when completing a COE on the basis of “personal subsistence.” The following is an example of a correct comment. Take special note when completing a COE on the basis of “personal subsistence.” The following is an example of a correct comment. OME states, “personal subsistence” means that the worker and the worker’s family, as a matter of economic necessity, consume, as a substantial portion of their food intake, the crops, dairy products, or livestock they produce or the fish they catch. The Laroach family catches salmon and consumes what they catch as part of their food supply.

Mr. Gonzalez states that he would be working for approximately a month labeling cherry bins then would be leaving for Oroville to pick apples. X State how many months the worker plans on working for the employer. Indefinitely Less than 12 months “However” if the worker states that he/she has “No” time frame of how long his/her employment would be ( indefinite ) or indicates that it might be more than 12 months, then the employment would be considered full- time, and NOT ELIGIBLE.

The employer states that Mr. Ramirez was hired on a temporary basis for three months packing apples. X State how many months the worker will be employed indicated by his/her employer. Indefinitely Less than 12 months “However” if the worker states that he/she has “no” time frame of how long his/her employment would be ( indefinite ) or indicates that it might be more than 12 months, then the employment would be considered full- time, and NOT ELIGIBLE.

X In regards to “moves of short duration” SEA has established policy to follow when completing a COE. Moves of short duration of less then one week. Due to economic necessity, the Valdez family picked cucumbers for 5 days to help their income. State if the move was for economic necessity. Make sure that there was a change in residence. State policy indicates a 48 hr stay for a residency on a qualifying move.

One purpose of the move was to seek or obtain qualifying work To obtain qualifying work and obtained qualifying work To obtain any employment and obtained qualifying work, soon after the move Specifically to obtain qualifying work, but did not obtain the work soon after the move OROR OROR Prior History to obtain qualifying work Other credible evidence that worker sought the work. AND OROR Specifically Non-Qualifying Work (e.g., c ook, janitor, mechanic) ANY employment HOWEVER Specifically to obtain QUALIFYING WORK but did not obtain the work soon after the move and PRIOR HISTORY of qualifying work. Mrs. Juanita Santana Ochoa who has a history of qualifying work, moved from Billings, MT to Toppenish, WA to work at Del Monte for the corn season as a grader, but soon after the move did not obtain work. In order to obtain To obtain ANY employment and obtained QUALIFYING WORK soon after the move: Mr. Jose Valdez moved from Fresno, CA to Mount Vernon, WA to work in ANY employment, then a few days soon after the move he began picking strawberries.
