6 Blasting Regulations (a)A certified blaster must obtain renewal of the certification every three (3) years. A request for renewal of the certification shall be, in writing, on a form furnished by the department. The request for renewal must be received by the department not later than thirty (30) days prior to expiration of the certificate. 312 IAC Renewal

7 Blasting Regulations (b)The renewal will be approved if the certified blaster: (1) has worked at least twelve (12) months of the preceding thirty-six (36) months as a certified blaster; (2) is not in violation of section 9 of this rule; (3) has obtained a minimum of fifteen (15) hours of additional training in the topics found in section 3 of this rule IAC Renewal

8 Blasting Regulations 312 IAC Renewal (b)The renewal will be approved if the certified blaster: (3)... Each certified blaster must provide documentation that fifteen (15) hours of additional training has been achieved. The training must be approved by the department.

9 Blasting Regulations (c)When the certification is not renewed for more than one (1) year after expiration, the certified blaster must retake the examination under section 5 of this rule and demonstrate completion of fifteen (15) hours of additional training in the previous thirty-six (36) months. 312 IAC Renewal

10 Blasting Regulations (c)… Certification will not be renewable. An application shall be submitted to the department in the event that the individual desires to again be certified, and the individual shall be considered as a new applicant. 312 IAC Renewal

11 Blasting Regulations 312 IAC Renewal (c)... When the certification is not renewed for five (5) years after expiration, the certification will not be renewable. An application shall be submitted to the department in the event that the individual desires to again be certified, and the individual shall be considered as a new applicant.

12 Blasting Regulations (d)A renewal notice will be sent to each registrant not less than two (2) months prior to the expiration date of the certification. 312 IAC Renewal

13 Blasting Regulations (e)All renewal notices and other communications will be sent to the last address given by the registrant to the department. A failure of the certified blaster to receive a renewal notice under this subsection does not relieve the certified blaster of the obligation to obtain a renewal of the certification as required under subsection (a). 312 IAC Renewal

14 Blasting Regulations (a)The competence of an applicant for certification as a certified blaster will be evaluated by reviewing and verifying the following: 312 IAC Examinations

15 Blasting Regulations (a)(1)The ability of the applicant to be directly responsible for the use of explosives in surface coal mining and reclamation operations through a written examination in the technical aspects of blasting and applicable Indiana and federal laws and regulations governing the storage, use, and transportation of explosives. 312 IAC Examinations

17 Blasting Regulations (b)An applicant for registration as a certified blaster shall be examined, in the topics set forth in section 3(c) of this rule. 312 IAC Examinations

18 Blasting Regulations (c)Admission to examination will be denied or deferred if the applicant lacks the necessary training required by section 3 of this rule or a minimum of one (1) year practical field experience. An applicant denied or deferred admission will be so notified, in writing, stating any reason for such denial or deferral. 312 IAC Examinations

19 Blasting Regulations (d)An examination notice will be sent to all applicants admitted for examination approximately six (6) weeks in advance of the regularly scheduled examination. This notice will establish the time and place of the examination and other instructions pertinent to the examination. … 312 IAC Examinations

20 Blasting Regulations (d)… Failure to appear for an examination will result in termination of the application unless the director, for good reason, extends the time for appearing. 312 IAC Examinations

21 Blasting Regulations (e)Only pass-fail grades will be issued. A passing grade will be issued to applicants who correctly respond to at least seventy percent (70%) of the questions contained on the written examination. 312 IAC Examinations

22 Blasting Regulations (f)Any applicant may review his or her examination answer sheets in the department = s Jasonville office at any time during normal working hours after the applicant has received notice of the examination results. … 312 IAC Examinations

23 Blasting Regulations (f)… The answer sheets will be retained in the department = s office for a period of one (1) year after the examination date after which time they will be destroyed. 312 IAC Examinations

24 Blasting Regulations (g) An applicant failing an examination may retake the examination two (2) times without reapplying. An applicant failing the examination three (3) times must retake the certified blaster training course. An applicant must notify the director, in writing, within sixty (60) days from the date of notice of failing, of their intention to retake the examination. The applicant will be scheduled for reexamination at the next scheduled examination. 312 IAC Examinations

25 Blasting Regulations (g)… Failure to notify the director will cause the application to be terminated, and the applicant must reapply for examination under section 4 of this rule. 312 IAC Examinations

26 Blasting Regulations A record of each blast, including seismograph records when obtained, shall be retained by the permittee for at least three (3) years and shall be made available for inspection by the director and the public on request. … 312 IAC Surface mining; explosives; records of blasting operations

(4)Direction and distance, in feet, to the nearest dwelling, school, church, or community or institutional building that is not owned or leased by the permittee. …

28 Blasting Regulations … The record shall contain the following data: 312 IAC Surface mining; explosives; records of blasting operations (5)Weather conditions that may cause possible adverse blasting effects, including temperature, wind direction, and approximate velocity. (6)Type of material blasted.

29 Blasting Regulations … The record shall contain the following data: 312 IAC Surface mining; explosives; records of blasting operations (7)Sketches of the blast pattern, including the following: (A)Number of holes. (B)Burden. (C)Spacing. (D)Decks. (E)Delay pattern.

30 Blasting Regulations … The record shall contain the following data: 312 IAC Surface mining; explosives; records of blasting operations (08)Diameter and depth of holes. (09)Types of explosives used. (10)Total weight of explosives used per hole. (11)Maximum weight of explosives detonated within any 8-millisecond period. (12)Initiation system. (13)Type and length of stemming. (14)Mats or other protections used.

32 Blasting Regulations … The record shall contain the following data: 312 IAC Surface mining; explosives; records of blasting operations (16)Seismographic and airblast records, when obtained, shall include the following: (A)Exact location of instrument and the date, time, and its distance from the blast. (B)Type of instrument, sensitivity, and calibration signal or certification of annual calibration.

33 Blasting Regulations … The record shall contain the following data: 312 IAC Surface mining; explosives; records of blasting operations (16)Seismographic and airblast records, when obtained, shall include the following: (C)Name of the person and firm taking the seismograph reading. (D)Name of the person and firm analyzing the seismographic record. (E)The ground vibration and/or airblast level recorded.
