3 Common Law Background Four basic crimes against persons Assaultive Assault Battery Mayhem Homicidal Murder Manslaughter Suicide Sex Crimes Rape, Sodomy, and Abortion False Imprisonment/ Kidnapping

4 American Developments In America crimes begin to be classified by seriousness The character of the victim and criminal The location and situation Rape has been redefined multiple times Varying degrees of sexual assault Marital status Crimes have to change and evolve with a changing society

5 Assault and Battery Commonly referred to together DIFFERENT CRIMES Assault Assault The threat of bodily harm No one needs to be touched for assault to occur, but it can’t be simply words alone Battery Battery Completed/ consummated assault Physical contact

6 Assault Statutes vary from location to location but commonly accepted Misdemeanor A punch (even a missed one) Being hit with a small stone Felony Firing a shot in the direction of a person Threatening someone with a weapon Battery Battery Hitting or pushing someone Unwanted hugging/ kissing

7 Aggravated Assault To determine this two questions must be answered: “deadly weapon?” 1)What constitutes a “deadly weapon?” “great bodily harm?” 2)Does the defendant intend to inflict “great bodily harm?” Guns, knives, etc. those are easy and obvious, but what about other items? Everyday items? SPECIFIC INTENT The Burden of the prosecution is to prove the SPECIFIC INTENT of the defendant
