4 Definition of disability in Israel Definition of disability in Israel Not uniform – varies in different NII branches For example: Work injury, hostile actions, Prisoners of Zion – medical impairment determines both definition of disability and rate of compensation. 5 Definition of disability in Israel Definition of disability in Israel General disability – only those who pass both medical tests and earning capacity (or household functioning) tests are defined as disabled. Polio and ringworm victims – definition of disability not affected by earning capacity. National Insurance Institute Research and Planning Administration

6 W ORK I NJURY National Insurance Institute Research and Planning Administration Work Injury Insurance began in 1954 and provides compensation to persons disabled as a result of work injury. A medical board determines the injured persons disability degree in accordance with (medical) tests stipulated in the law. When the injured person is not capable of returning to his or other work, and his income is reduced, his disability degree may be raised by half of that determined by the medical test.

8 National Insurance Institute Research and Planning Administration The work disability pension is calculated thus: Those with 100% disability degree receive monthly pension at rate of 75% of their wages in quarter-year preceding injury. Those with partial disability degree receive partial pension, in proportion to degree. Rate of pension not affected by number of injured persons dependents.

10 G ENERAL D ISABILITY National Insurance Institute Research and Planning Administration The definition of disability is determined both by medical tests and by functional tests. Medical threshold: 60% disability 40% if there is 25% disability from a single impairment 50% for housewives The disability degree is determined by a NII physician.

11 National Insurance Institute Research and Planning Administration Those who pass the medical threshold – an incapacity degree is determined for them. Categories of entitlement of working disabled: A. Severely disabled – medical disability of at least 75% or 40% in impairment # 33 (psychotic disorder) or # 91 (mental retardation) OR Long-term disabled – those who were entitled to monthly pension for 60 out of 184 months before August 2008 B. All the rest.

15 National Insurance Institute Research and Planning Administration General disability pension – aims at guaranteeing disabled minimum income for subsistence. In addition, the following benefits may be paid (regardless of entitlement or non- entitlement to disability pension; according to other criteria): attendance allowance – to assist disabled in household functioning mobility allowance – to assist disabled with mobility outside the home benefit for disabled child – to assist families incare of disabled child (up to 18) at home Additional Assistance
