3 The modernisation process of the European Customs Union
From the Treaty of Rome of 1957 to the Treaty of Lisbon of 2007: The EU enlargement to 28 Member States in an area without internal borders EU exclusive competence in the customs union field The customs codification process : from the Community Customs Code of 1992 to the Union Customs Code entered in force on 1st May 2016 Increased security and development of compliance

4 EU customs code: the new role of customs
Articles 3 and 57 of the Code: Primary responsibility for monitoring international trade Coordination of the clearance process according to the single window and the one-stop-shop principles Goals: To protect the financial interests of the EU and its Member States; To protect the Union from unfair and illegal trade, while supporting legitimate businesses; To ensure the security of the Union and its citizens, as well as to protect the environment, where necessary in close cooperation with the other authorities, and To maintain an adequate balance between customs controls and legitimate trade facilitation

Regulation (EU) no. 952/2013 of 9th October 2013 of the European Parliament and of the Council laying down the Union Customs Code; Commission Delegated Regulation 2446/2015 of 28th July2015, supplementing Regulation No. 952/2013; Commission Implementing Regulation 2447/2015 of 24th November 2015 laying down detailed rules for implementing certain provisions of Regulation (EU) no. 952/2015; Commission Delegated Regulation (EU) n. 341/2015 of 17th December 2015, of the European Parliament and of the Council as regards transitional rules for certain provisions of the Union Customs Code; Commission implementing Regulation 481/2016 of 1st April 2016 repealing the remaining provisions previously in force Commission Implementing Decision 2016/578 of 11th April 2016 establishing the Work Programme relating to the development and deployment of the electronic systems provided for in the Union Customs Code

The major innovations : Strong orientation to simplifications : Reduction and simplification of special procedures Simplification of the value determination Review of the guarantee system Review of the customs declarations and other formalities Codification and proceduralisation of customs decisions Central role of the Authorised Economic Operator (AEO) Complete use of data-processing techniques (perhaps by 2020)

Tools for the electronic management of fulfilments at the EU level Tools for further facilitating secured legal trade flows at national level : Customs single window and controls; Clearance at sea; Monitored corridors

CONCLUSIONS Combated Scenario worldwide: Abatement of trade barriers and liberalisation of trade: TFA, CETA, etc.; versus Reintroduction or consolidation of trade barriers: reviews or abandonment of certain trade agreements (for example: NAFTA, TPP, TTIP) The customs role and function remain the reference point for spurring global economic growth
