The European maritime transport space without barriers is the concept which extends the Common Market to sea transport. The effective implementation pre-supposes a simplification of administrative procedures and a change in the existing regulatory framework. It will be supported by the development of electronic data exchange systems and surveillance capabilities by coastal and authorities in ports

Guidelines for speeding-up checks relating to animal and plant products (in 2009). Rationalisation of administrative formalities for vessels arriving at /departing from EU ports

11 | 11 European maritime transport space without barriers Revision implementing provisions OBJECTIVE. WHEN: Adoption early 2009. WHAT: Amendment of the Implementing Provisions. AIM: Presumption that goods shipped between Community ports have a Community status.

Vessels shall not come from, go to or call at any ports outside this territory or in a free zone of control type I. Goods are are carried under cover of a single transport document drawn up in a Member State. Non-Community goods carried on board these vessels will be covered by a transit procedure.

13 | 13 European maritime transport space without barriers Revision implementing provisions CONSEQUENSE. The current "authorised regular shipping services" can therefore be repealed.

14 | 14 European maritime transport space without barriers Revision implementing provisions MODALITIES. New rules should enter into force in 2010. The reduction of administrative burden for intra- Community maritime transport shall not induce adverse effects on other categories of sea transport carrying third-country goods. This will add to the benefits from the Modernised Customs Code and e-Customs in terms of reduction of administrative burden

16 | 16 European maritime transport space without barriers Directive on reporting formalities for ships arriving in or departing from EU ports  Overlap between EU requirements and IMO FAL (general declaration, waste declaration… EU forms asks more detailed information)  Need to update forms in directive 2002/6 IMO FAL = Convention on Facilitation (FAL) adopted in the International Maritime Organisation (IMO )

17 | 17 European maritime transport space without barriers Main provisions  The proposal states that formalities requested by existing EU legislation prevail. FAL forms will not be requested for information already required by EU legislation.  FAL Forms will not be required for intra-Community maritime transport.  The proposal introduces a specific form for security pre- arrival information, which will be repealed when a harmonised form will be adopted in IMO.  As early as possible and at the latest on 15 February 2013, all information will have to be channelled through an electronic National Single Window. This Single Window for navigation will be interoperable with the Single Window for goods based on Decision 70/2008 on e-customs.
