2. 2 >Originally, the existing Emergency Alert Service/System (EAS) in the early 60’s provided the President with a means to push a message to the nation through the nation’s mass media. >The alerts can be used to warn of natural or man-made disasters >In light of new technologies since the creation of EAS, the FCC in a recent rulemaking proceeding has examined updating EAS The FCC released a Report and Order already focused on broadcasters including cable In a Further Notice of Proposed Rulemaking, the FCC has focused mostly on wireless. >The Department of Homeland Security apparently has taken the lead on EAS for the current Administration pursuant to a recent Executive Order issued on June 26, 2006. “…establish a common system to alert and warn the American people of an emergency to public safety and well- being.” The EAS should be capable of working through as many communications pathways as practicable. The EAS must have the capability to alert those with disabilities and those without an understanding of English. DHS to work with owners and operators of communications facilities to maintain, protect, and restore capabilities necessary for the EAS. DHS to submit a plan for the implementation of this order with in 90 days to the President. >Legislation has been introduced, but passage unclear House and Senate versions of the WARN Act Two other bills introduced in the House >Wireless industry has urged the creation of EAS using a WPS model. Introduction While currently no EAS requirements exist for wireless/cellular carriers environment, this is about to change.

3. 3 >CTIA sponsored industry conference calls to discuss industry responses to the Congressional and FCC activities. >The CTIA initial proposal calls for use of SMS as the short term EAS technology with a view of later adoption of a better technology. Recognizing the shortcomings of SMS as an EAS technology, the industry proposes that six predicates be met: 1. The system must be [voluntary for carriers and] opt-in to a specified zip code for consumers as with Wireless AMBER Alerts. 2. This service should be limited to only transmit Presidential or Governor-level messages. 3. Government must deliver messages to a single point of aggregation, like the wireless AMBER Alert. 4. Limitation of liability for participating carriers is necessary. 5. Support cost recovery mechanisms and government support for new deployments. 6. Government must deliver emergency alert messages in a format that can be retransmitted using the SMS protocol. >CTIA and the industry held their first meeting on May 4, 2006 with key government officials in attempt to define the service requirements for a longer term wireless emergency alert service. 4. 4 Current Front Runner Solution >Short Message Service (SMS) Pros/Cons for SMS - All major operators have deployed SMS and its supported on nearly all existing handset. - SMS interworking between GSM and CDMA operators exists today. - No guarantee that EAS message will be delivered before expiration of EAS event. - No guarantee that EAS message will be received by all handsets. - No guarantee that handsets will receive EAS messages in the order they were created. - No mechanism to cancel delivery of expired EAS alert messages. - No specific alerting for identifying the EAS messages from other types of SMS messages.
