14 Dock Location A two foot increase towards the northerly property line is necessary to accommodate the gangway, which is 24 feet long, the City’s minimum required length Dock cannot be moved further south as suggested by the marina owner because pier is five feet from the southerly property line, which is the minimum setback Gangway cannot be shortened and access pier cannot be moved any further south because of City Harbor Regulations

15 Conclusion The proposed dock located entirely within the applicant’s water area and is setback from the property line in excess of local requirements (23.4 feet where requirement is 5 feet) Commercial marina cannot rely on private homeowner’s property line for access to the marina Access will remain unimpeded
