5 Mitigation CAI-13-08-018 authorized wetland impacts as well as a mitigation plan for the Royal Cypress project site. The applicant proposes the following modifications: Impact an additional 0.16 acres of Class I wetlands in order to construct portions of the proposed boat ramp facility. The applicant proposes to purchase 0.03 credits from the Reedy Creek Mitigation Bank as mitigation. Purchase 1.61 credits from the Reedy Creek Mitigation Bank in lieu of preserving 30.38 acres of offsite wetlands at the Latham Mitigation Area.

7 Variance Requests The Application to Construct a Boat Ramp Facility includes three (3) variance requests: 1.Section 15-605(b)(5) (electrical and lighting setback). The Code prohibits electrical outlets and lighting within one hundred (100) feet of any boat ramp facility. Due to site constraints, the applicant proposes interior electrical outlets, pool lighting, landscape and hardscape lighting within 100 feet of the boat ramp. 2. Section 15-605(b)(11) (side setback). The Code states, “no portion of any boat ramp or any type of boat ramp facility shall be closer than twenty-five (25) feet from the projected property line of abutting shoreline owners.” The proposed boat ramp will be 15 feet from the adjacent parcel, also owned by Toll FL Limited Partnership which has been placed under conservation easement.

8 Variance Requests 3. Section 15-605(b)(14) (letter of credit). The Code requires, “the applicant to post a one-year irrevocable letter of credit, in favor of Orange County, in the amount of 10% of the assessed value of the boat ramp facility site...” The applicant has proposed to post a letter of credit in an amount of 10% of the estimated cost to construct the boat ramp facility x 125%. The County has accepted this in the past. EPD supports the three variance requests.

10 Proposed Conditions 39.The launching of watercraft from this semi-private boat ramp shall be limited to the residents of Royal Cypress Preserve. Usual and customary guests may utilize the boat ramp only when they are with a resident and only with the resident’s watercraft. Usual and customary guests may not use the semi-private boat ramp to launch their own watercraft. 40. The use of the ramp shall be limited to the hours of 6:00am to 8:00pm. No overnight mooring of watercraft is allowed at the boat ramp. Any watercraft utilizing the boat ramp shall be removed from South Lake prior to 8:00 pm. 41.The boat ramp will require a gate code or security device that will only allow residents of Royal Cypress Preserve to gain access to the boat ramp. The security device shall only allow access between the hours of 6:00am and 8:00pm.

11 Action Requested Approval of Semi-Private Boat Ramp Facility Permit (BR- 14-08-003) with approval of the three (3) variance requests, subject to the conditions listed in the staff report, and the three (3) new conditions, as presented. Approval of the modification to Conservation Area Impact Permit (CAI-13-08-018), subject to the conditions listed in the staff report. District 1

15 Staff Report Conditions 15.A variance to Section 15-605(b)(5) (electrical outlets and lighting) is hereby granted for the boat ramp facility to be located within 100 feet of electrical outlets and lighting. 16.A variance to Section 15-605(b)(11) (side setback) is hereby granted for the boat ramp facility to be located less than 25 feet to the property to the southeast. 17.A variance to Section 15-605(b)(14) (letter of credit) is hereby granted. The applicant shall provide a letter of credit, in the amount of ten (10) percent of the cost to construct the boat ramp facility, multiplied by 125%, in favor of OC.
