2 Civil Service Commission Term and Qualifications of Commissioners (sec. 2502) 5-member body Created in 1935 3-year term Must be a resident of city Must be U.S. citizen Must be an elector

3 Civil Service Commission May be removed by City Council for – Incompetency – Incompatibility – Dereliction of Duty – Malfeasance in Office – Other good cause (sec. 2502)

4 Civil Service Commission Requirement for Conduction of Business – 3 members constitute a quorum – 3 members concurring decides all matters Vacancies filled by majority vote of Council – For unexpired terms – For term expirations

7 Civil Service Commission California Constitution A city may adopt a charter by majority vote of its electors The provisions of a charter are the law of the State and have the same force and effect A charter provides the manner of appointment, method of appointment, and terms of appointment for city employees A charter provides for the removal of employees; the number and types of employees; method of appointment; and qualifications of employees

8 Civil Service Commission City Charter Grants power over municipal affairs to the City Council Municipal Affairs include: Determining the number and types of employees The Compensation to be paid to employees Service levels to be performed Lay off and reductions in service

9 Civil Service Commission City Council The Council determines the level of service and the number and types of employees through the adoption of the annual budget (§ 1908) The Council may not interfere with the City Manager nor dictate the appointment or removal of any City employee who is appointed by the Manager (§ 408) The Council may deal with City employees only through the City Manager, City Attorney, City Clerk, or City Auditor (§ 408) The Council may investigate any financial transaction, official acts, and conduct of any employee or department of City government (§ 406)

10 Civil Service Commission City Manager Is the Chief Executive Officer of the City responsible to the City Council for the efficient administration of all affairs of the City. Is the Final Appointing and Removal Authority for all positions, except Attorney, Clerk, and Auditor Prepares and submits annual budget Recommends service reductions and lay offs Other duties as assigned by the City Council Enforces Civil Service Rules and decisions of the Commission

11 Civil Service Commission Commission Article XXV establishes the Civil Service Commission Establishes the Classified Service for Police and Fire Authorizes the Council to establish the Miscellaneous Classified Service Authority limited to how employees are: RecruitedDisciplined (Appeals) ExaminedRemoved AppointedReinstated

14 Civil Service Commission Commission Administrative Authority Establish eligible lists Certify names for appointment Keep official roster of employees Prepare and submit reports to City Council

15 EQUAL EMPLOYMENT COMMISSION The Civil Service Commission also sits and serves concurrently as the Equal Employment Commission.

16 In Summary City Council Determines the number and types of employees Commission Determines how those employees are recruited, examined, retained, removed, and reinstated City Manager Determines when those employees are appointed and removed

17 ROLES OF DIRECTOR OF HUMAN RESOURCES AND CHIEF EXAMINER The Director of Human Resources has been delegated authority from the City Manager over labor and employment matters. The Chief Examiner, who is separate and distinct from the Director of Human Resources, oversees the examination process.
