1 Form of Government 1 Responsibilities of the Strong Mayor drafted by the City Attorney’s Office December 2010

2 Form of Government  Must be elected by a majority, necessitating a probable run-off election.  Term of Mayor commences on the first Tuesday in April, or if a run-off election, then the first Tuesday in June of the odd-numbered years.  Council may review Mayor’s proclamation in times of public danger or emergency and may terminate by majority.  Mayor shall review all finally passed ordinances of Council within 48 hours thereafter for final adoption; must sign for approval within five days or if disapproved in writing, return to Council within five days. Council can override the Mayor’s veto by six votes within five days after Mayor’s disapproval. Council-Mayor Form of Government – Mayor Responsibilities: 2

3 Form of Government  Mayor can disapprove specific line items in any ordinance appropriating funds without disapproving the entire ordinance. This is subject to override by Council.  The Mayor has no power to disapprove by veto an ordinance accomplishing any quasi-judicial act, an ordinance approving bonds to be issued by any City enterprise, an ordinance pertaining to Utilities, an ordinance submitting a Charter amendment to a vote of the electors, or an ordinance proposing a Charter convention. 4 Form of Government  Mayor shall be the chief executive and enforce all laws and ordinances; shall be the head of the City government for executing legal instruments, for ceremonial purposes, and for purposes of military law. The Mayor may take command of the police and govern the City by proclamation in times of public danger or emergency. The Mayor shall give reports to Council on the condition of the City and execute all contracts ensuring that they are faithfully kept and fully performed.  The Mayor shall not hold any other paid employment position during the term in office. 5 Form of Government  The Mayor shall submit to the citizens a strategic plan that prioritizes goals for the City and establishes measurable outcomes, including the Comprehensive Plan and five-year capital improvements plan for municipal needs – with public input – and to be used to develop the budget. There shall be an annual “State of the City” report to citizens.  The Mayor shall prepare and submit to the citizens on or before June 30 of each year, a report on the financial condition of the City. The City shall publish the mid-year and end-of-year financial reports. Council-Mayor Form of Government – Mayor Responsibilities: 5

6 Form of Government  The Mayor shall appoint and suspend or remove any City government employee, excluding employees of City Utilities and City’s health system but may authorize any administrative officer subject to the Mayor’s direction and supervision to exercise these powers with respect to subordinates.  The Mayor shall appoint a Chief of Staff. Subject to confirmation by the concurring vote of a majority of the members of City Council, the Mayor shall appoint these positions to serve at the pleasure of the Mayor: City Clerk, City Attorney, Municipal Judges, Chief Financial Officer/Controller, Police Chief, Fire Chief, heads of public works, parks, community development, and the airport. 7 Form of Government  The Mayor has the right to attend and be heard at any regular or special open meetings of Council.  On or before the first Monday in October, the Mayor shall furnish to Council estimates in writing of the probable expenses to be incurred in the City for the ensuing fiscal year. At the same time or later as fixed by Council, the Mayor shall prepare an annual budget for the ensuing year.  The Mayor shall serve as an ex officio and non- voting member of the Board of Directors of Utilities.  The Mayor shall be paid an annual salary of $96,000 to be adjusted up or down every four years based upon the most local consumer price index for all urban consumers published by the U.S. Department of Labor, Bureau of Labor Statistics, beginning April 2011, in addition to benefits standard to all full-time City employees. 8 Form of Government  Mayor shall establish rules for the appeals of discipline of striking employees.  The City shall begin to transition to the Council- Mayor form of government as soon as the Charter revisions are adopted. The current Mayor shall remain in place under the Council-Manager form of government until the Mayor is elected for the Council-Mayor form of government.
