4 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union INSTITUTIONAL FRAMEWORK CAA is responsible body for coordination and monitoring of the implementation of aviation security measures - Law on Air Transport (“Official Gazette of Montenegro”, No. 30/12 of 8 June 2012), Art. 139 and 140 and National Civil Aviation Security Program (NCASP), Art. 18. Chapter 14

5 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union INSTITUTIONAL FRAMEWORK Some of the CAA tasks: Preparing draft of the NCASP and National Civil Aviation Security Quality Control Programme (NCASQCP) Establishing list of prohibited articles Monitoring activities including audits, inspections, tests and surveys Coordinating activities with other state institutions Cooperation with international organizations Approving Security programmes of airport operator, air carrier and other entities Approving Training programmes and instructors Preparing meetings of the National Civil Aviation Security Committee Chapter 14

6 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union NATIONAL CIVIL AVIATION SECURITY COMMITTEE - NCASC Chapter 14 Members of the Security Committee are representatives of the:  Ministry of internal affairs  Ministry of transport and maritime  Ministry of defense  CAA  Intelligence service  Police Administartion  Customs Administation Main tasks of the NCASC are to manage actions in crisis situations caused by unlawful interference in accodance with NCASP and to analyze the level of danger and decide on the application of additional security measures.

8 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union LEGAL FRAMEWORK  National Civil Aviation Security Quality Control Programme - NCASQCP, fourth edition, adopted by the Government on 14 March of 2013  Other acts: List of prohibited articles, established by CAA, (Ref. N. 04/1-1676/1-2013 of 3 December of 2012) Regulation of the manner of handling the explosive, flammable or hazardous substances as well as means and objects which are on the list of prohibited articles, (“Official Gazette of MNE”, No. 18/2013 of 2 April of 2013) Chapter 14

9 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union IMPLEMENTATION OF EC LEGISLATION NCASP is fully harmonized with the: Regulation No. 300/2008 of the European Parliament and of the Council of 11 March 2008 Regulation No. 272/2009 of 2 April 2009 Regulation No. 1254/2009 of 18 December 2009 Regulation No. 185/2010 of 4 March 2010 Decision No. 2010/774/EU of 13 April 2010 NCASQCP is fully harmonized with the: Regulation No 18/2010of 8 January 2010. 10 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union IMPLEMENTATION OF EC LEGISLATION Regulations amending Regulation 272/2009, 185/2010 and Decision 2010/774/EU All EU regulations before June of 2011 are incorporated in NACSP, so regulations No 297/2010, 357/2010, 358/2010, 573/2010, 983/2010 and 334/2011 and Decisions 2010/2604/EU, 2010/3572/EU and 2010/9139/EU are incorporated in NCASP. Regulations No 720/2011, No 1141/2011, 1087/2011, 1147/2011, 173/2012, 711/2012 and 1082/2012 and Decision No 2011/8042/EU are not incorporate in NCASP. Chapter 14

11 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union IMPLEMENTATION OF EC LEGISLATION However, some of them are not valid anymore, like Reg. 720/2011- Deadline for LAGs, some of them are not applicable for us like Reg. 1082/2012 - EU validation for cargo. Regulations No. 1141/2011, 1147/2011 and Decision No. 2011/8042/EU are only for security scanners, which we do not use in Montenegro in this moment. Reg. 1087/2011 is only for deadlines for EDS. Regulation 173/2012 - almost all regulation is incorporated in NACSP, but in some cases we have more stringent measures and the same case is with Reg. 711/2012. Chapter 14

12 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union ECAC and ICAO audits  ECAC conducted in September of 2011 full scale audit at Podgorica airport  In August of 2011 ECAC conducted targeted follow-up audit at Tivat airport (initial audit was conducted in 2010) Results of these audits were very good, especially for Podgorica airport where around 90% of all security measures were assessed as category 1, which means fully compliant. Conclusions for both of these audits were that our regulation is fully harmonized with ECAC.DOC.30/13th edition, which is the equal with EC legislation. The same conclusion was given by expert team of EC who assessing implementation of ECAA agreement - they conclude that we finish Phase I of the Agreement, what means that our regulation is harmonized with EC legislation. 13 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union ECAC and ICAO audits Chapter 14  ICAO conducted in February of 2013 full scale audit at Podgorica airport The result of this audit was that we are fully harmonized with ICAO Annex 17 and ICAO Security Manual 8973.

14 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union IMPLEMENTATION OF EC LEGISLATION - CONCLUSION Chapter 14  In this moment, our legislation in aviation security are harmonized with EU legislation with exceptions that in some cases we have more strengthten measures than measures in Reg. 173/2012 and Reg. 711/2012 or we did not introduce new technology like security scanners which means that some of these regulations are not applicable for us, in this moment.  However, we already prepared third edition of the NCASP, and in that version we incorporate all EU legislation (also some regulations from 2013) in aviation security and third edition of the NCASP is in final stage of approving, so we believe that new NCASP will be adopt by Government during the June of this year.
