2 Human Trafficking Definition Buying, selling, bartering, recruitment, transportation, transfer, harboring and receipt of persons By mean of, Threat, Force, Fraud, Deception, Inducement, Abuse of position of vulnerability For the purpose of, Exploitation of others, other form of sexual exploitation, forced labour, slavery, services, practices similar to slavery, servitude and removal of organs

3 How does trafficking occur Recruitment Partly deceptive recruitments : Victims may be aware that they are to be employed in a given activity but do not know under which conditions. Fully deceptive recruitment : victims are lured by promises of employment and financial gain and are fully deceived as to the true intention of the trafficker Forcible recruitment

4 How does trafficking work Transportation Origin, transit and destination countries Eg. Sri Lanka has been identified as a origin country Legally or illegally Travel by land, air or sea Often accompanied by agent who take the custody of travel document

5 How does trafficking work Exploitation Traffickers transport their victims for the sole purpose of personal gain, often either to make larger amount of money from their exploitation or to obtain free services or labour.

6 Exploitation Sex Exploitation/Sex Trafficking Increasing demand for sex tourism in many places, increase trafficking of women and children are into prostitution and pornography Sri Lanka is highly vulnerable, Booming Tourism Industry Tsunami disaster

7 Exploitation Labour Trafficking People enslaved in forced labor, bonded labor, forced child labor and involuntary servitude. Many low-skilled laborers and economic migrants trafficked to more prosperous and developed places remain in captivity under threat of physical and verbal abuse, harm to their families, and threats of deportation

8 Street Begging or peddling Forced military service Eg; Recruitment of Child soldiers by LTTE Organ removal Exploitation

9 Legal Enactments to prevent trafficking Section 360 C of the Penal Code (Amendment) Act No. 16 of 2006 Convention on Preventing and Combating Trafficking in Women and Children for Prostitution Act. No 30 of 2005

10 Punishment Section 360 C of the Penal Code, Any person who is the guilty of the offence of trafficking shall on conviction be punished with imprisonment of either description for a term not less than twenty years and not exceeding twenty years and may also be punished with fine where such offence is committed in respect of a child be punished with imprisonment of either description for a term not less than three years and not exceeding twenty years and may also be punished with fine

11 Punishment Convention on preventing and combating trafficking in women and children for prostitution Act. No 30 of 2005 Any person who is guilty of an offence under the above Act shall be punished with imprisonment of either description for a period not less than three years and not exceeding fifteen years and fine. Compensation would be recovered to be paid to victim In case of offence committed subsequently, punishment will be doubled.

12 Human Trafficking & ML Human Trafficking is an unlawful activity prescribed under the Prevention of Money Laundering Act. No. 5 of 2006

13 Measures to prevent human trafficking Establishment of Anti-Human Trafficking Task Force To increase the co-ordination among stakeholders & to support successful prosecutions and protection of victims, the Ministry of Justice has taken the initiative to establish an Anti-Human Trafficking Task Force with the support of the International Organization for Migration

14 Measures to prevent human trafficking Action Taken by the Sri Lankan Bureau of Foreign Employment (SLBFE) Rank employment agencies based on number of complains received. Compulsory registration of all migrant worker to ensure that they understand the terms of their service. Cancellation of License and imposition of fines on foreign employment agencies.
