1 COMBATING TRAFFICKING IN HUMAN BEINGS IN LITHUANIA DATE COLLECTION & ANALYSIS SYSTEM THB Investigation Unit of Lithuanian Criminal Police Bureau March 2012 BRATISLAVA

2 Since 2006 specialized (THB investigation) unit in the Criminal Police Bureau; 32 specialized prosecutors, 15 police officers – 10 of them in 10 districts of Lithuania. Lithuanian Criminal Police Bureau, as a law enforcement agency, carries out operative activities, inquiry, pre-trial investigation, co- operate with law enforcement and other institutions and agencies of the Republic of Lithuania and foreign countries, non-governmental organizations, the international organizations on issues within its competence, co-ordinate interaction of other institutions and their information systems, perform other functions laid down by law.

4 Article 147 of the Criminal Code of the Republic of Lithuania. Trafficking in Human Beings. 1. A person who sells, purchases or otherwise conveys or acquires, recruits, transports or holds in captivity a person by using physical violence or threats or by depriving him/her of a possibility of resistance otherwise or by taking advantage of the victim’s dependence or vulnerability or by resorting to deceit or by accepting or paying money or by receiving or granting any other benefit to a person who actually has the victim under his control, where the offender is aware of or seeks the exploitation of the victim under slavery conditions or conditions resembling slavery for the purpose of prostitution, pornography, or other forms of sexual exploitation, forced labour or services, including beggary, for the commission of a criminal act or other purposes of exploitation, whether the victim agrees or not shall be punished by imprisonment for a term of two up to ten years. 2. A person who commits the act provided for in paragraph 1 of this Article in respect of two or more victims or by posing threat to the life of the victim or by participating in an organised group or being aware of or seeking the victim’s organ, tissue or cells to be taken or being a civil servant or a person performing the functions of public administration and exercising the powers, shall be punished by imprisonment for a term of four up to twelve years. 3. A person having suffered from the activities provided for in this Article may be released from criminal liability for a criminal act which he/she was directly forced to commit as a result of the act committed with regard to him/her provided for in this Article. 4. A legal entity shall also be held liable for the acts provided for in paragraphs 1 and 2 of this Article.

5 Article 157 of the Criminal Code of the Republic of Lithuania. Purchase or Sale of a Child 1. A person who offers to purchase or otherwise acquire a child, sells, purchases or otherwise conveys, acquires, recruits, transports or holds in captivity a child, while being aware of or seeking his/her illegal adoption, exploitation under slavery conditions or conditions resembling slavery for the purpose of prostitution, pornography, or other forms of sexual exploitation, forced labour or services, including beggary, for the commission of a criminal act or other purposes of exploitation, irrespective of his/her consent shall be punished by imprisonment for a term of three up to twelve years. 2. A person who commits the act provided for in paragraph 1 of this Article in respect of two or more children or young children or posing threat to the life of the victim or by participating in an organised group or being aware of or seeking the victim’s organ, tissue or cells to be taken or being a civil servant or a person performing the functions of public administration and exercising the powers, shall be punished by imprisonment for a term of five up to fifteen years. 3. A person having suffered from the activities provided for in this article may be released from criminal liability for a criminal act which he/she was directly forced to commit as a result of the act committed with regard to him/her provided for in this article. 4. A legal entity shall also be held liable for the acts provided for in paragraphs 1 and 2 of this Article.
