8 RC 3314.35 Closure Criteria 2013-14 School Year If a school does not offer a grade level higher than grade 3, school required to close if: –Rated Academic Emergency in school year 2011-12 AND –Graded F on improving K-3 literacy in 2013-14

9 RC 3314.35 Closure Criteria 2013-14 School Year If a school offers any grades 4-8, but no grade higher than 9, school required to close if: –Rated Academic Emergency AND showed less than one year growth in reading/math in school year 2011-2012 AND –Graded F on PI Score and on Value- Added Progress Dimension in school year 2013-14

10 RC 3314.35 Closure Criteria OR –Graded F on PI Score and F on Value- Added Progress Dimension in both school years 2012-13 and 2013-2014

11 RC 3314.35 Closure Criteria 2013-14 School Year If a school offers any of grades 10 to 12, school required to close if: –Rated Academic Emergency in school year 2011-12 AND –Graded F on PI Score in school year 2013-14 AND –Failed to meet AMOs in school year 2013- 14

12 RC 3314.35 Closure Criteria OR –Graded F on PI Score in both of school years 2012-13 and 2013-14 AND –Failed to meet AMOs in both of school years 2012-13 and 2013-14

13 RC 3314.015 Sponsor Agreement Term and Probationary Status Initial term of a sponsor’s agreement with ODE shall be for up to seven years The Department shall add one year to the term of a sponsor’s agreement for every year the sponsor is: – Prior to 1/1/2015, not in the lowest 20% of sponsors statewide –After 1/1/2015, rated “exemplary” or “effective” on Sponsor Performance Review (SPR)

14 RC 3314.015 Sponsor Agreement Term and Probationary Status If ODE finds that a sponsor is not in compliance with rule and law, ODE may, in lieu of sponsor revocation, place the sponsor on “probation” ODE shall provide written notice to the sponsor identifying areas of noncompliance with rule and law –ODE and SBOE shall adopt rules for notifying a sponsor of noncompliance with rule and law –Applies to both conversion and new start up schools

15 RC 3314.015 Sponsor Agreement Term and Probationary Status Sponsor has 14 days to respond with proposed corrective action plan to remedy areas of noncompliance ODE has 14 days to approve/disapprove submitted plan If disapproved, process for submitting revised plan If approved, sponsor required to implement plan not later than 60 days after initial notification of noncompliance or 30 days after plan is approved

16 RC 3314.015 Sponsor Agreement Term and Probationary Status If sponsor does not implement an approved plan, ODE shall notify the sponsor in writing that the sponsor is in probationary status ODE may limit sponsor’s ability to sponsor additional community schools when a sponsor is placed on probation Probationary status will not be lifted until the sponsor applies to ODE and provides evidence that the sponsor is in compliance with rule and law

17 RC 3321.01 Early Entrance to Kindergarten and First Grade Community schools are subject to RC 3321.01 (early entrance) via RC 3314.03 RC 3324.10 (acceleration) requirements are included in RC 3321.01 HB 59 changes are effective September 29, 2013 –Amended RC 3321.01 –Added Section 263.473

18 RC 3321.01 Early Entrance to Kindergarten and First Grade Students who do not meet the date for regular admission into kindergarten or first grade may be considered for early entrance Community schools, via governing authority- adopted policy, sets the date for regular admission (August 1 or September 30) SB 316 (effective September 24, 2012) changed the law to require early entrance ONLY via acceleration in accordance with RC 3324.10

19 RC 3321.01 Early Entrance to Kindergarten and First Grade HB 59 changed the law AGAIN A student who is not 5 or 6 by Aug 1/Sept 30, but will turn 5 or 6 by January 1, may be referred for early entrance –Must be referred by parent, school educator, pediatrician, psychologist or preschool teacher –Must be evaluated in accordance with governing authority’s adopted Early Entrance policy –Policy dictates assessment tool(s) and criteria for early entrance

20 RC 3321.01 Early Entrance to Kindergarten and First Grade A student who is not 5 or 6 by Aug 1/Sept 30, but will turn 5 or 6 on or after January 1, may be referred and considered for acceleration –Must be evaluated in accordance with governing authority’s adopted Acceleration policy, which must comply with RC 3324.10 –Assessment tool = Iowa Acceleration Scale (IAS)

21 RC 3321.01 Early Entrance to Kindergarten and First Grade After a student has been properly admitted to kindergarten in a school district or chartered nonpublic school under RC 3321.01, no board of education of a school district to which the student transfers shall deny admission based on the student’s age. –For purposes of RC 3321.01, a community school = a school district

22 RC 3321.01 Early Entrance to Kindergarten and First Grade HB 59 Section 263.473 –For the 2013-14 school year only, any student who was admitted to and successfully completed kindergarten in the 2012-13 school year shall be admitted to first grade regardless of age –“Successfully completed kindergarten” means that the student attended kindergarten for not less than three-fourths of the school year

23 RC 3314.072 Suspension of Community School Contracts Beginning with the 2013-14 school year, a community school contract shall be become void if a sponsor suspends the contract and required corrective action is not taken –If sponsors suspends contract per statute, the governing authority must provide a proposal to remedy the conditions cited by the sponsor as reasons for suspension –Deadline = September 30 of the school year immediately proceeding the school year in which the school was suspended

24 RC 3314.072 Suspension of Community School Contracts If a sponsor has suspended the operation of a school prior to September 29, 2013, the community school contract shall become void if the governing authority fails to provide by September 30, 2014, a proposal to remedy the conditions cited by the sponsor as reasons for the suspension All proposals submitted per RC 3314.072 must meet the satisfaction of the sponsor
