6 Collective redundancy consultation The 90-day minimum collective redundancy consultation period for large-scale redundancies was reduced from 90 days to 45 days - from 6 April 13.

7 Settlement agreements Compromise agreements are now called ‘settlement’ agreements, with a new statutory Code of Practice and guidance – from 29 July 13

8 Nationals of Bulgaria and Romania Nationals of Bulgaria and Romania, the ‘A2’ countries who joined the EU in 2007, had their restrictions on working in any EU Member State lifted from 1 January 14.

9 Transfer of undertakings reform Transfer of undertakings reform – changes to the TUPE Regulations came into effect on 31 January 14.

10 The right to request flexible working The right to request flexible working will be extended to all employees with 26 weeks' service – from 30 June 2014.

11 DISCLOSURE & BARRING SERVICE

12 Changes Applicant Only Copy of the DBS Disclosure Certificate Update Service – Workforce question DBS & Police have started filtering certain offences

13 Applicant Only Copy From June 2013 the DBS stopped issuing a Registered Body copy of the DBS Disclosure Certificate Applicant has control of their Criminal Record data For paper applications employers will not be advised when a Disclosure Certificate has been dispatched, if it is clear or has information returned (positive)

14 How to find the result If using paper applications employers will have to contact the applicant to view their DBS Disclosure Certificate Online applications will provide results giving employers the disclosure number, date of issue, if it is clear or has information returned and generate a clearance email for clear disclosures. When using the online service only Disclosures that contain information will have to be viewed.

15 Check the certificate Use the guide ‘How to check a DBS Disclosure Certificate’ Ensure that only the original certificate is viewed If using paper applications and the Disclosure is clear, record the disclosure number and date of issue for your SCR If information is disclosed ‘Positive’ carry out a risk assessment of the information

16 Update Service Allows individuals to take their existing DBS Disclosure to use for similar roles with different organisations One DBS check for life (conditional) Employers can check status of an individual’s Disclosure

17 Filtering of offences It will no longer be the case that all convictions, cautions, reprimands and warnings will appear on a disclosure Certain offences will always appear, as will all convictions that resulted in a custodial sentence All unspent convictions will still appear ‘One-off’ minor offences over 11 years old will no longer appear
