1 Concept Development The 2 nd, 3 rd and 4 th Amendments to the Constitution guarantee certain protections to every citizen. These amendments were added to prevent the government abusing it’s people. The framers had learned this lesson from British rule in the colonies. AmendmentWhat it Does Second Amendment Maintains the right of the people to bear arms 1. Third Amendment Prevents Quartering of troops in people’s houses Fourth Amendment Prevents the government from search and seizure 2 of a person’s property without a warrant 3 or probable cause 4. 1 Bear arms: own or possess weapons 2 Search and seizure: to look for items or take a person’s property 3 Warrant: an order signed by a judge for an officer to search or arrest. Pair-Share: If the government passed a law that outlawed all guns, is that constitutional? Why or why not? Pair Share: What do you think the British did that made the framers want to include the third amendment? Pair-Share: If an officer wants to search someone’s house, what does he or she need first? 4 Probable Cause: reason to believe something illegal is happening Learning Objective: Students will be able to describe the citizen protections in the 2 nd, 3 rd and 4 th amendments

2 Skill Development/Guided Practice 1. Read the text carefully 2. Decide if the action taken is constitutional or not. 3. Explain why or why not. Situation Constitutional or Unconstitutional? Why? 1. Jason is pulled over by the police. When he rolls down his window in front of the officer, the officer smells marijuana. The officer says he has probable cause asks Jason to step out of the car as he searches for marijuana. Constitutional 4 th amendment- probable cause 2. Congress passes a law outlawing all guns in the United States. Unconstitutional 3. The President orders that the citizens of Lemoore need to house soldiers from Lemoore Naval Air Station. 3 rd Amendment- can’t force people to house soldiers 4. Jennifer’s parents are away. A police officer asks to enter the house saying that he needs to search the house for something dangerous. When asked for a warrant, the cop says he doesn’t have it but will give it to her parents when they come home. The police enter the house. 5. Police come to John’s house saying they have a warrant to search for illegal weapons. They show it to him and they enter the house and find nothing.

4 Relevance It is important to know your citizen protections because… – You should always know your rights if you are ever stopped by a police officer or if an officer comes to your house. – Issues involving gun rights are a BIG part of our national debate. Ex. Should the government ban automatic weapons or are these protected under 2 nd amendment rights? (P-S) Ex: We agree that people should have a license to carry a weapon, should they be allowed to have one if they have a criminal record? (P-S) – An educated population is necessary for our democratic-republic to continue. – Your 2 nd, 3 rd and 4 th amendment rights are on the test. – It is on state testing.
