School officials violated state anti-discrimination law when they would not allow a transgender fifth-grader to use the girls' bathroom, Maine's highest court has ruled. Denver: A Colorado civil rights panel has ruled that a suburban Colorado Springs school district likely discriminated against Coy Mathis when it prevented her from using the girls' bathroom. August 2013, SACRAMENTO, CALIFORNIA  California on Monday became the first state to enshrine certain rights for transgender kindergarten-through-12th grade students in state law, requiring public schools to allow those students access to whichever restroom and locker room they want.

30  A Utah lawmaker has proposed a bill that would prevent transgender students from using bathroom facilities of their choice. Rather than allowing transgender students to use facilities set aside for the gender they identify with, schools would be required to provide additional bathrooms for transgender students who desire one or whose families request one.

32 OCONOMOWOC (WITI) — A transgender elementary student in Oconomowoc has sparked a change in school policy regarding using the bathroom. It’s an issue the district is dealing with for the first time. Concerns were brought to the attention of faculty and staff on Friday, September 6th after a transgender student at Summit Elementary School used the female bathroom while another student was inside. Said Superintendent Roger Rindo, “Student confidentiality is our primary concern.” After complaints from parents, the Oconomowoc School District has made a decision to provide a unisex bathroom at each school in the district. “What’s really important is that we’re not singling anyone out — that anybody can use that bathroom,” said Rindo. Jody’s view: trans-students are still being told they must use a specific bathroom. They have no choice. Their true genders are not being recognized. And, this will still single them out. “Special bathrooms” are stop-gap measures at best. That said, at least it’s a start.

The school board shall provide a copy of the policy to any person who requests it. Annually, the school board shall distribute the policy to all pupils enrolled in the school district and to their parents or guardians.

Oregon School District (approved unanimously July 2013) Federal law prohibits discrimination with respect to religion, race, color, national origin, sex, age and handicap. State law prohibits discrimination also with respect to ancestry, color, physical, mental, emotional or learning disability, pregnancy, marital or parental status, sexual orientation, arrest or conviction record and military service. In addition, the Board prohibits discrimination or harassment based on transgender status including gender expression, gender identity and gender non-conformity. NOTE: It is GSAFE’s opinion that this is the clearest and overall best language to use.
