1 PRESENTATION ON NPA’S ROLE IN IMPLEMENTING THE TIP BILL SELECT COMMITTEE ON SECURITY AND CONSTITUTIONAL DEVELOPMENT WEDNESDAY, THE 20 TH FEBRUARY 2013

3 INTRODUCTION The Bill, once passed into law, imposes the following obligations upon NPA: -To perform prosecutions of all offences provided for in the Bill; -To participate in the development of National Policy Framework; -To participate in the development of regulations regarding the manner in which prosecutors must refer children and adult persons suspected of being victims of trafficking for assessment; -To develop & issue policy directives to be complied with by all members of NPA who are tasked with the institution of and conducting prosecutions of Trafficking in Persons cases; and -To develop training courses for prosecutors on directives, incorporating social context training, which will provides for and promotes the use of uniform norms, standards and procedures to ensure that all prosecutors are able to deal with matters relating to trafficking in persons in an appropriate, efficient and sensitive manner.

4 NPA TIP TASK TEAM The NPA has established the Task Team in October 2012 The Team comprises of all representatives from Business Units at the National Office and all offices of Directors of Public Prosecutions The Team is coordinated by the Sexual Offences and Community Affairs Unit (SOCA UNIT) The Team is to prepare NPA’ state of readiness to implement the Bill, once enacted into law

5 RESPONSIBILITIES OF THE NPA TIP TASK TEAM The responsibilities of the Task Team are: -Draft annexures to the charge sheets, to be ready at the time the Bill becomes law -Develop process & mind maps -Make submission on regulations relating to prosecutors’ function regarding referral of children and adult persons suspected of been victims of trafficking for assessment -Draft policy directives as required by the Bill -Review the current training materials in line with the provisions of the Bill

6 RESPONSIBILITIES OF THE NPA TIP TASK TEAM continues -To serve as a training team for prosecutors on trafficking in persons training materials -To develop a uniform TIP statistics collation tool -To serve as a nodal point for TIP statistical information -To monitor the proper implementation of the TIP Bill, once it becomes law -To participate in the development of the National Policy Framework as required by the Bill -Intersectoral Provincial Task Teams will be responsible for public awareness & education.

7 NPA TIP TASK TEAM’S WORK IN PROGRESS The NPA TIP task team held its first meeting from 29 th to 31 st January 2013 The meeting resolve to formulate the following as a work priority list -Developing a uniform TIP statistics collation tool -Review the training materials -Develop training implementation plan -Draft annexures -Draft policy directives -Participate in the development of regulations -Participate in the development of the National Policy Framework Work have been undertaken in all areas of the responsibilities of the Task Team, herewith included is the action log as decided upon by the Task Team during their 1 st session.

8 SKILLS DEVELOPMENT Specific Integrated training manual developed for relevant stakeholders dealing with trafficking, training sessions delivered: -2010/11, 6 sessions, 191 delegates -2011/12, 13 sessions, 295 delegates -November 2012, 1 session, 18 delegates Sexual Offences (Act 32/2007) training manual developed for prosecutors, including session on Trafficking (sections 71 & 72) & other related offences. Number of sessions delivered: -Since 2008 until March 2012, 38 sessions attended by 993 prosecutors -Since June 2012 until to date, 6 sessions attended by 113 prosecutors Compiled an Integrated training manual for stakeholders involved at TCC’s, as from 2011/12, 20 sessions, attended by 484 delegates. In the current financial year 2012/13, 22 sessions attended by 628 delegates. This training also includes trafficking as reflected in Act 32/2007 and the Children’s Act (section 284) Act 38/2005.
