Supt. of Public Instruction to provide program guidelines for gen ed. and special ed.  SB 277 clarification on vaccination requirements to be provided by CA Dept. of Public Health  AB 114 MH Audit is in process. 3 2015-16 ERMHS Timeline Nov. 2nd: LEAs submit Annual Mental Health Plan(s) to SELPA by 5:00 pm Dec 1st: SELPA compiles an official LEA SEIS service count Jan 15th: LEA submits Budget Request(s) to SELPA by 5:00 pm Feb 28th: SELPA conducts a second Finding of Sufficiency of Funding July 13th: Final Expenditure Report due by 5:00 pm Nov 9 th : MH Data from SEIS sent to schools for review Steering Meeting | October 21

4 CDE Updates State Systemic Improvement Plan (SSIP)  Department focused on building structure for implementing the SSIP in alignment with LCFF  LEA performance reviewed annually through annual performance reports  Not meeting targets required to develop an improvement plan Arching goals focused on:  Increasing attendance and time in class  School culture and behavior (suspensions and expulsions)  Focus on CCCS, UDL, MTSS  Goals aligned with Task Force Report Steering Meeting | October 21

5 Sanction letters for 34 districts were mailed 9/24 Response required by 10/20 Same student….same problem in:  June 2014  December 2014  April 2015  June 2015 Assessment scores for 2014-15 are out. As predicted student outcomes hover around the 11-12% – meets expectations for students with disabilities. NEW!  If the student is not in CALPADS marked as a student with a disability, then the child will not be able to take the test with accommodations. Steering Meeting | October 21 CDE Updates

6 CASEMIS/CALPAD S CASEMIS – December 1 (see prep guidelines) *. 2015-16 discipline data will be collected in CALPADS. Undecided at this time if also collected in Table C of CASEMIS. For the discrepancy report, LEAs will be required to file a report for 2014-15. LEAs will submit to SELPA who will submit to CDE. Sub-committee will meet December 15 to discuss transition to CALPADS. CDE will start pilot in 2017-18 and complete transition in 2018-19. Steering Meeting | October 21

8 Data Identified Non-Compliance (DINC)* June 2015 data used for DINC findings. Use last date of attendance as the date of correction. CDE auditing the “code 90” reasons. Reminder: “No staff” or “staff on leave” is not an excuse. SELPAs will soon have access to monitor. Call your program techs and programs specialist for guidance. Adhere to the November 30 due date! 10 Legal Updates Remember the Rachel H. Factors considered in OAH:  Educational Benefit in Gen. Ed.  Nonacademic (social) benefits in Gen. Ed.  Effect on teacher and other students  Cost consideration Goal of IDEA is to foster student independence Do not write in providers (names, agency, etc.) on IEPs. Use district of service as the code. Ensure providers align with IEP (i.e. need, certifications/qualifications, expertise are in sync with services). Do not write methodology in IEP (i.e. Orton-Gillingham). Steering Meeting | October 21

11 Legal Updates School officials responsible for implementing student’s IEP are considered to have “legitimate educational interest” in receiving the document. Include language in annual FERPA notice. Regardless of transportation regulation/policy; transportation must be provided if student requires it to receive FAPE. Test protocols – provide them! 12 Guidance: Office of Special Education Programs (OSEP) Letter to Baus (OSEP 2015): If parent disagrees with assessment because student was not assessed in particular area, parent has the right to an IEE. Dear Colleague Letter (OSEP 2015): Expressed concerns that many students with autism were not receiving needed speech and language and that SLP may not be included in evaluation and/or IEP process. Memorandum to State Directors (OSEP 2015): Remind LEAs of obligation to evaluate all students, regardless of cognitive skills that are suspected of having one of the 13 disabilities. Letter to Sarzynski (OSEP 2015): If parents cannot attend in person to develop and review their child’s service plan, OSEP expects LEAs to use other methods to ensure parent participation.
