10 S ECTION 30230 Section 30230 Marine resources; maintenance Marine resources shall be maintained, enhanced, and where feasible, restored. Special protection shall be given to areas and species of special biological or economic significance. Uses of the marine environment shall be carried out in a manner that will sustain the biological productivity of coastal waters and that will maintain healthy populations of all species of marine organisms adequate for long-term commercial, recreational, scientific, and educational purposes. S AN D IEGO C OAST D ISTRICT S LIDE 10 Orcas are apex predators that help maintain the health and carrying capacity of marine environments. Many captive orcas originated from the wild and partake in captive breeding. National Marine Fisheries Service has not issued a permit for wild take of orcas since the 1980’s, but future permits for take is still a possibility. Captive orca programs could create incentive for such future wild take.

11 S PECIAL C ONDITION N O. 1 Authorized Orca Facility.By acceptance of coastal development permit No. 6-15- 0424, the applicant agrees to implement the project as originally proposed and as amended by the SeaWorld Addendum to the Blue World Project Description dated September 21, 2015, and consistent with all special conditions, including that the Project will be managed consistent with the Virgin Pledge against collection of killer whales from the wild. Based on the Virgin Pledge, to which SeaWorld is a signatory, the Project will not be home to any killer whales taken from the wild after February 14, 2014 and no genetic material from any killer whale taken from the wild after February 14, 2014 will be utilized, with the exception of rescued killer whales approved by one or more government agencies for rehabilitation or deemed by one or more government agencies as unfit for release into the wild. The Project killer whale population will not significantly increase except as may occur incrementally through sustainable population growth consistent with reproductive guidelines of one or more nationally recognized marine mammal accreditation organizations. The Project may be home to beached or rescued whales at the request of one or more governmental agencies. S AN D IEGO C OAST D ISTRICT S LIDE 11

17 C ONCLUSION S AN D IEGO C OAST D ISTRICT S LIDE 17 Proposed development could impact marine mammals in the marine environment under Section 30230 Special Condition No. 1 prohibits the use of orcas taken after Feb. 14, 2014 SeaWorld has adequate water quality systems to treat runoff from the project site and the park in general. Expansion will not change general operation of recirculated system. Development is substantially below grade and not visible from public park areas. Adequate on-site parking and operation levels of surrounding intersections lessen likelihood of public access impacts. The proposed development is not expected to cause a substantial increase in attendance levels that could adversely impact public access.
