1 Should there be boundaries to what students should be able to say to a teacher or other students at school? If so, what are the limits? If not, why not? Call To Order

2 Objective Political scientists will be able to evaluate the extent to which students have freedom in American schools by examining how student rights have been expanded by Tinker v. Des Moines Independent School District. To what extent does the Bill of Rights apply to students in school?

4 Where do you stand? Move to the corner of the room that represents your opinion: strongly agree, agree, disagree, or strongly disagree.

5 Since the government can't take free speech away from you, the school should't be able to either.

6 Free speech is not a guaranteed right, so it's okay if the government or the school takes it away from you.

7 In order for a school to function, there must be rules prohibiting behavior that violates a school's educational mission.

8 School discipline is a part of children's development as good citizens.

9 If a teacher hears a student being bullied, the teacher should report it and the school should be able to give the bully consequences.

10 Schools are for learning, and real learning includes debate over controversial issues. Thus, interacting with students with different viewpoints is part if the educational process.

11 Allowing students to wear what they want, like rosary beads or sneakers, will lead us down a sloppy slope. Students will see this as a reason to break other school rules as well.

12 Students should be able to publish what they want in the school newspaper, even if it criticizes the people who run the school.

13 Cursing should be allowed in school.

14 Tinker v. Des Moines Independent School District John and Mary Tinker were a brother and sister who went to school wearing black armbands to protest the Vietnam war. The Principal suspended the students. The students believed that their first amendment right to freedom of speech had been violated.

15 Tinker v. Des Moines Independent School District The students took their case to the Supreme Court. They ruled that students do have freedom of speech, as long as they are not distracting the learning process. This set the precedent that students have free speech, within limits.

16 Stop and Jot Write an example of free speech allowed at school. Write an example of speech that would not be allowed.

17 Sort, List, Label I will give you and your partner cards with different opinions on them. You and your partner will divide them into two piles -- one for the Tinkers and one for the school district, depending on which side you think would have said each of the opinions.

18 Chalk Talk When the white board comes to you, answer the question to the best of your ability. Write small! You have 1 minute for each round.
