3 Basic Information Petitioner: John F. Tinker and Mary Beth Tinker (minors) (SPLC) Respondent: Des Moines Independent Community School District (SPLC) Question: Does a prohibition against the wearing of armbands in public school, as a form of symbolic protest, violate the students’ freedom of speech protections guaranteed by the First Amendment? (Tinker) Decided by: US Supreme Court (Warren Court) on February 24th, (Tinker) Decision: Tinker won 7-2 (Tinker)

4 How does it apply to student publications?
Relates because of freedom of expression and opinion (SPLC) First Amendment applies in the school (SPLC) Due Process Clause (14th Amendment) (SPLC) Will affect future case’s decisions (SPLC) Students should use these as talking points while presenting. For example, for the second bullet point the students should discuss this case established that school aged minors also had First Amendment rights.
