8 ARTICLE 5: AMENDING THE CONSTITUTION  Article 5:  The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress

9 Amendment Process 1)Proposal: - By a 2/3 vote in Congress - Or by a national convention 2)Ratification: - By ¾ of the states by a vote in each legislatures - Or by calling special state conventions

10 Interpreting the Constitution  Loose interpretation:  Congress should be allowed to make any laws not forbidden by the Constitution.  Strict interpretation:  Congress should only be able to make the kinds of laws that the Constitution mentions.

11 Necessary and proper clause:  Congress has the power “to make all laws which shall be necessary and proper” to carry out its duties.
