1
National Legislation on in- service inspections and the PED
2
Overview Comparison of former MSt. and EC legal systems Interfaces between legislation on PE of MSt. and EC Consequences for MSt. Regulations on putting into service and in-service inspection
3
Framework of former Member States regulations on PE Scope including technical requirements on design, manufacturing and operating procedures Conformity assessment procedures, putting into service requirement, periodic in-service inspection Detailed coherent requirements
4
Framework of EC regulations on PE Scope covers requirements for placing on the market and putting into service Essential safety requirements Choice of the manufacturer on technical solutions Module system on conformity assessment includes QM Extension of manufacturer responsibility
5
EC legal systems on SPVD and PED EC legal systems on SPVD and PED Placing on the market and aspects of putting into service under the regime of SPVD and PED Aspects of putting into service, in- service inspections and operational procedures under the regime of MSt. regulations
6
Interface between legislation on PE of MSt. and EC Putting into service In-service inspections Operational requirements Assemblies PE covered by Art. 3.3 PED Safeguard clause
7
Interface putting into service Art. 2 PED defines the task of MSt. of protection of persons during use of PE Modifications to PE laid down in national regulations are not permissible On site situation may affect the safety National regulations on the environment of the PE National regulation based on technical requirements only
8
Interface putting into service MSt. regulations Requirements on the environment of the PE; e.g. define zones of potentially explosive atmosphere damage limitation requirement affecting the place of installation; e.g. boiler house, underground LPG vessels Control of labelling and documentation Control of transport damages
9
Interface In-service inspection In-service inspection is not covered by the scope of PED Annex I PED offers a broad range of technical solutions Required extent and kind of in-service inspection determined by the technical solution chosen
10
Examples of relevant technical aspects on In-service inspections corrosion internal/external fatigue, cycle loadings temperature influence, creep, brittleness material behaviour
11
Objectives in the context of In-service inspections To establish adequate technical solutions of safety To meet the obligations of the Treaty on free trade Equal treatment of PE independently from the country of origin
12
Difficulties in the context of In-service inspection PED requirements on information's for the user Information exchange between manufacturer and user Different design solutions (based on different Codes) permissible Inspection bodies often familiar only with their National Codes
13
Consequences for national regulations on in-service inspections Requirements shall be based on technical criterions only Requirements on the documentation justifying resistance against specific loads may be demanded Formal requirements e.g. - involvement of a specific notified body - compliance with a specific national code are an infringement of the Treaty
14
General tendency of new Regulations on in-service inspections More flexibility for decisions on intervals and kind of examinations More responsibility given to the users
15
Structure of Austrian the in-service regulation General requirements for in-service examination methods Specifications on in-service requirements for some standard PE (e.g. LPG storage tanks) 4 groups based on operational loads in connection with PE design, PE has to be classified in one of these groups Procedure for flexible determination on in-service inspections for special PE which cannot be grouped
16
Perspectives European harmonised rules for placing on the market alone will not guarantee safety National In-service Regulations which are imposing barriers of trade will endanger the advantages of the common market Further development in regard of safety and economic aspects will depend on the quality of National In-Service Regulations
