3 Legislation Developing since 1960 1971 Pennsylvania Association for Retarded Children wins a land mark case Vocational Rehabilitation Act of 1973 Section 402 The American Disability Act Education for all Handicapped Children Act of 1974-P.L. 94-142 Individuals with Disabilities Education Act (IDEA)

4 Vocational Rehabilitation Act of 1973 Section 402 This is related to nondiscrimination under Federal Grant, P.L. 93-112 no otherwise qualified handicapped individual in the US shall solely by reason of his handicap be excluded form the participation in be denied the benefits of or be subjected to discrimination under any program or activity receiving Federal Financial assistance

5 Vocational Rehabilitation Act of 1973 Section 402 Free appropriate public education Falls under the management of regular education; disability do not qualify for SPED still eligible for accommodations Installing ramps modifying restrooms to provide access for individuals with physical disabilities falls under 504 12 Enforcement offices headquarters in Washington D.C.

7 Education for all Handicapped Children Act of 1974-P.L 94-142 Act of 1974-P.L 94-142 states all between ages of 3 and18 must be proved with free and appropriate public education: appropriate meaning where would the child learn the best Amendment of 1983-P.L.98-199 – Extended the use of federal aid to state and local school systems to 1987 – Increased assistance to deaf and blind children – Expanded serves to birth to age 5

8 Education for all Handicapped Children Act of 1974-P.L 94-142 Amendment of 1986:Infants and Toddlers with Disabilities-P.L. 99-457 – Established statewide, comprehensive, coordinated, multidisciplinary, interagency program of early intervention services for the child with special needs and their family; this law addresses early and easy recognition of children with disabilities – Getting the child and family the services that they need early in the child’s life – More information at American Council on Rural Special Education (ACRES)(ACRES)

9 Individuals with Disabilities Education Act (IDEA)(IDEA) Previously the Education for all Handicapped Children which stated that all children receive and education regardless of the severity of their disability Was reauthorized in June 1997 went in effect on July 1, 1998 and then again in 2004 going into effect on July 1, 2005: reauthorized every 4 years Bothe the 1997 and 2004 had 4 parts – A. General provisions B. school age and pre school 3-5 yr old C. infants and toddlers birth thought age 2 D. support Individuals with Disabilities Education Improvement Act (IDEIA) created in 2006 with new regulations

10 Individuals with Disabilities Education Act (IDEA) Individualized Education Program (IEP) this help to make with making sure that the child is receiving the education needed in the right setting and level IEPs illustrate the goals that the schools and parents want for the the child with a disability
