2 Department of Business How will this affect you All existing licensing will continue No change to the way applications are lodged with the department Applications lodged prior to 1 January: –Not yet considered by NTLC will be dealt with by Director General –Already considered by NTLC will proceed as advised by the NTLC

3 Department of Business Elements of the Reform Abolish Northern Territory Licensing Commission to be replaced by the Director-General of Licensing No longer required to hold hearings Director General can delegate for efficiency and timeliness of responses Independent review of decisions by the NT Civil and Administrative Tribunal

5 Department of Business Director-General of Licensing Licensing (Director-General) Act –Establishes the position of Director-General of Licensing –Combines Licensing functions (including Acts) –Provides broad powers necessary to perform functions –Allows for delegation of powers and functions –Creates a review process for any decisions made under delegation

6 Department of Business The Acts to be amended Liquor Act Gaming Machine Act Gaming Control Act Private Security Act Totalisator Act Prostitution Regulation Act Kava Management Act Tobacco Control Act

7 Department of Business Liquor Act Objectives, public interest and general criteria remain the same Notice will continue to be required Objections can continue to be made Applicant will have a right of reply to objections Decision notice provided to applicant and persons who object

8 Department of Business Liquor Act Public consultation around restricted area will continue to apply Complaint and disciplinary process Decisions notice issued Right of review to the NT Civil and Administrative Tribunal for Disciplinary action

9 Department of Business Private Security Act Definitions are included to support the review process Right of review transferred to the NT Civil and Administrative Tribunal (previously Local Court and NT Licensing Commission) Rectify a duplication with applications and disqualifying offences

10 Department of Business Gaming Machine Act Definitions are included to support the review process Notice will continue to be required Objections can continue to be made Applicant will have a right of reply to objections Decision notice provided to applicant and persons who object Right of review to the NT Civil and Administrative Tribunal
