5 Defense Equal Opportunity Management Institute DEFINITION OF SEXUAL HARASSMENT “Sexual harassment is a form of sex discrimination that involves unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature when:

9 Defense Equal Opportunity Management Institute DEFINITION OF SEXUAL HARASSMENT “Any person in a supervisory or command position who uses or condones implicit sexual behavior to control, influence, or effect the career, pay, or job of a military member or civilian employee is engaging in sexual harassment. Similarly, any military member or civilian employee who makes deliberate or repeated unwelcome verbal comments, gestures, or physical contact of a sexual nature is also engaging in sexual harassment.”

12 Defense Equal Opportunity Management Institute SOCIALLY ACCEPTABLE IN CERTAIN SITUATION, BUT CAN POTENTIALLY BE SEXUAL HARASSMENT IF IT IS REPEATED ENOUGH TIMES SOMETIMES SOCIALLY ACCEPTABLE, BUT SOME REASONABLE MEN AND WOMEN WOULD BE OFFENDED AND WANT THE BEHAVIOR STOPPED NOT SOCIALLY ACCEPTABLE; REASONABLE MEN AND WOMEN WOULD BE OFFENDED AND WANT THE BEHAVIOR STOPPED NEVER SOCIALLY ACCEPTABLE, AND ARE SO GRAPHIC AND SEVERE THAT ONE INSTANCE DEMANDS ACTION LIGHT * SUBTLE MODERATE SEVERE ** * Light behaviors are more likely to be called inappropriate or out of line, but not truly harassment, especially if only one instance has occurred. ** Severe behaviors include physical abuse such as attempted and actual rape or sexual assault, and verbal abuse such as serious sexual slurs. To determine whether a particular behavior constitutes sexual harassment, begin by plotting the behavior on this continuum:
