2 Virginia Stormwater Management Program – § 10.1-603.2 Definition: “Virginia Stormwater Management Program or VSMP means a program approved by the Board after September 13, 2011, that has been established by a VSMP authority to manage the quality and quantity of runoff resulting from land-disturbing activities and shall include such items as local ordinances, rules, permit requirements, annual standards and specifications, policies and guidelines, technical materials and requirements for plan review, inspection, enforcement, where authorized in this article, and evaluation consistent with the requirements of this article and associated regulations.”

3 VSMP Program Authority- § 10.1- 603.2 Definition: “Virginia Stormwater Management Program authority or VSMP authority means an authority approved by the board after September 13, 2011, to operate a Virginia Stormwater Management Program or, until such approval is given, the Department. An authority may include a locality; state entity; including the Department; federal entity; or, for linear projects subject to annual standards and specifications in accordance with subsection B of §10.1-603.5, electric, natural gas, and telephone utility companies, interstate and intrastate natural gas pipeline companies, railroad companies, or authorities created pursuant to §15.2-5102.”

15 Submittal Timeframe Timeline for submittal of final adopted local stormwater programs – January 2013 through June of 2013 Soil & Water Conservation Board can grant a one year extension to the June 2013 deadline. Draft programs must be submitted to Regional Office by April 1, 2013 to receive extension Soil & Water Conservation Board can approve programs through June of 2014

16 Funding & Staffing Plan Required Elements Indentify anticipated construction activity and compare to existing staff levels Determine level of increased staff time based on provisions of regulations Determine additional staff and other resources needed (computers, administrative) Identify budget to cover these costs for the long term (may include combination if fees & other funding sources such as general funds)

17 Cooperative programs are an option The development of cooperative programs between local governments or with agencies can make local programs economically feasible. § 10.1-603.3.H. Delegated authorities may enter into agreements with soil and water conservation districts, adjacent localities, or other entities to carry out the responsibilities of this article.
