2 Eligibility for Assessment National Health and Community Care Act 1990 S47 (1) ‘ Where it appears to a local authority that any person for whom they may provide or arrange for the provision of community care services may be in need of such services, the authority shall carry out an assessment of his needs for those services’.

4 Eligibility for Services from the Local Authority Based on Government Guidance ‘Fair Access to Care Services’ (D. of H. Guidance 2003) Intention: To remove ‘post-code lottery’ between local authorities Over-riding Principle: Eligibility for services determined on the basis of the assessed risk to a persons independence.

5 F.A.C.S. Domains Autonomy Physical and mental health and safety Management of daily routines Involvement in family and community life

6 Levels of Risk Critical Substantial Moderate Low

7 Eligibility for Service under F.A.C.S. Only eligible where: A person does not wish, or is unable to arrange their own care and support and There is no on else willing, able or appropriate to help. People whose needs have critical consequences for their independence to be supported ahead of those with substantial consequences. No obligation to provide any particular type or volume of service. No obligation to provide for people whose circumstances pose only a moderate/low risk to their independence.
