37 Treaties: Locating Authoritative Text United States treaties Article II Section 2 of the U.S. Constitution gives the president the power "by and with the advice and consent of the Senate to make treaties, provided two-thirds of the Senators present concur." Article VI states that the Constitution and "the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land."
