Crash Impediments Ordinance Update Orange County BCC September 1, 2015

Presentation Outline  Background  Barrier Location Standards  Staff Recommendations  Requested Action

Presentation Outline  Background  Barrier Location Standards  Staff Recommendations  Requested Action

Background  BCC presentation on February 10, 2015 – Findings of staff work group Crash statistics Orange County child day cares Best practices – General framework for crash barrier ordinance  BCC presentation on May 5, 2015 – Technical approach for crash barrier ordinance – Grant program overview

Background  Safety of child day care facility is related to: – Speed of the road – Setback distance of structure or outdoor play area  Buildings or outdoor play areas within a safety impact zone would require crash barriers

Background  Implementation – New child day cares at permitting – Existing day cares would have 2 years to comply  Grant program – Business Assistance for Neighborhood Corridors (BANC) – Managed by Neighborhoods division – General fund grant, $200,000 per year – Countywide eligibility

Presentation Outline  Background  Barrier Location Standards  Staff Recommendations  Requested Action

Barrier Location Standards  Ordinance language to set specific standards regarding design criteria – Bollard type (ASTM WK 13074) – Location (between road and building, outdoor play area, sidewalks, parking areas) – Spacing (every 4-5 feet, allow for ADA)  Reviewed a number of existing commercial and residential day care facilities

Barrier Location Standards  Commercial Day Care #1 – Single road frontage – Play area behind principal structure

Barrier Location Standards  Commercial Day Care #2 – Double road frontage – Play area to side of principal structure

Barrier Location Standards  Commercial Day Care #3 – Single road frontage – Play area behind principal structure but adjacent to parking

Barrier Location Standards  Commercial Day Care #4 – Single road frontage – Multiple structures with play area set back from road but adjacent to parking

Barrier Location Standards  Residential Day Cares – Home is the principal use – Small number of children – Exposure from road not property address

Barrier Location Standards  Typical steps/approx. costs for compliance – Survey$1,500 – Design$2,000 – Permitting$1,000 – Installation$700 per bollard Approx. total$11,500 (10 bollards, 50 feet) $18,500 (20 bollards, 100 feet) $32,500 (40 bollards, 200 feet)  Proposed grant program likely inadequate

Presentation Outline  Background  Barrier Location Standards  Staff Recommendations  Requested Action

Staff Recommendations  Each existing child day care facility poses unique challenges  Other crash barrier ordinances focusing on ingress/egress areas to commercial buildings  Options 1.Exempt existing child day cares from ordinance 2.Exempt existing, but offer matching grant to willing facilities 3.Extend compliance timeline, increase grant funding

Staff Recommendations  LPA Worksession on June 18, 2015  General concerns included: – Need for ordinance – High costs to small business – Timetable for compliance – Outreach to day care community – Aesthetics

Staff Recommendations  New ordinance schedule – Finish drafting ordinance (September - November) – Outreach to community (December - January) – LPA Work Session (February - March) – BCBOAA Public Hearing (April) – LPA Public Hearing (April - June) – BCC Public Hearing (June - July)

Presentation Outline  Background  Barrier Location Standards  Staff Recommendations  Requested Action

Requested Action  Finalize crash barrier ordinance  Applies only to new commercial child day cares  Exempt existing child day care facilities with option for 50/50 grant for those facilities that choose to comply voluntarily

Background  Severity of crash is a factor of vehicle speed and building setback distance – Kinetic Energy is energy which an object possesses due to its motion – Average Vehicle Weight 3500 – 4000 Lbs. – Vehicle Force > 330,000 ft-lbs. @ 50mph

Background  Orange County Child Day Cares – 706 child day cares in Orange County – 116 child day cares in unincorporated Orange County are at-risk Roadway Posted Speed Limit ≥ 35 Average Daily Traffic Count > 15,000 Building setback from road ≤ 150 feet

Proposed Ordinance  Technical requirements – ASTM WK 13074 standard Stop a 5,000lb vehicle @ 30mph – Appearance and maintenance Reinforced walls, planters, street furniture, etc. Exclusions – plain concrete, jersey barriers

 Business Assistance for Neighborhood Corridors (BANC)  Existing day cares only  Financial criteria difficult to establish – No franchises – Maximum number of children – Average income of surrounding residential neighborhoods Grant Program

 Grant program funding related to: – Number of impacted child day cares – Cost to private sector – County grant to share costs  How many child day cares in…? – Orange County – “Unincorporated” area – Non-residential – Non-franchised Data from DCF, April 2014 706 474 287 252

Grant Program  Focus on unincorporated, non-residential, non- franchised child day cares Roadway Speed Safety Impact Zone Unincorp, non-res Unincorp, non-res, non fran. <=30mph100ft9985 35mph125ft2523 40mph153ft6758 45mph180ft4441 50mph213ft33 55mph246ft54 >60mph285ft11 Approx 170 impacted facilities 287 (244) 252 (215) Exempt facilities on 30mph or less roads
