3 European Commission - DG ENV.A.5 Current Situation Seveso II Operators of establishments covered by Articles 6 and 9 (so called upper tier establishments) need to establish a Safety Report. The Seveso II Directive had to be transposed not later than 3 February 1999. The specific deadline for sending safety reports was 3 February 2001, for establishments not previously covered by Seveso I 3 February 2002.

4 European Commission - DG ENV.A.5 Current Situation Seveso II Situation End 2002: - 3278 upper tier establishments were reported from the 15 Member States - The number of establishments that have submitted safety reports as required under Article 9 of the Directive is 2870 (on average 88 %). -1129 or 39 % of the submitted safety reports had been examined

11 European Commission - DG ENV.A.5 Amendment Modifications Article 9 Safety report 1.The safety report … shall name the relevant organisations involved in the drawing up of the report. 2.The safety report shall be sent to the competent authority within the following time limits: for establishments which subsequently fall within the scope of this Directive, without delay, but at all events within one year after the transposition deadline 1. July 2005. 3. Annex II (Minimum Data), point IV B: Assessment of the extent and severity of the consequences of identified major accidents including maps, images or, as appropriate, equivalent descriptions, showing areas which are liable to be affected by such accidents arising from the establishment …

12 European Commission - DG ENV.A.5 Amendment The following point is added to Article 9(6): "(d)The Commission is invited to review by 31 December 2006 in close cooperation with the Member States, the existing "Guidance on the Preparation of a Safety Report."
